Park with ease

Hi, So ive looked through the threads and FAQs and nothing seemed very relative.
Ive had a NTK for parking in a YHA car park the driver has done this before and spoke to them and never had any issues on quieter days as this was, however the YHA in question had no staff on at the time of the parking and the driver didn't see any signs although didn't look very hard.
The main issue for the driver is the amount of the charge (£50). if the driver was to stay the night at said YHA on a Tuesday it would cost only £15 including parking.
I the Keeper have written to YHA asking for some kind of reasoning for this company sending me a NTK for "parking in a permit holders car park without a valid permit" how could the driver get a permit if no one was on the property. I am pretty sure there is not a pay machine and when I personally have stayed at the property they have never given me a permit.
Do you have any advice for my next move?
Any help is gratefully appreciated.

    Send it unchanged - no additions or alterations needed.

    Send it as the keeper.

    Send the first appeal but after that, no posts/updates till court stage please. See you in 2020 when you really need help. That's when IPC cases are won (at court stage).

    ALWAYS complain to the landowner, however. Without saying who was driving.

  • So my appeal was rejected, now I did notice that the contract the driver allegedly entered into states driver should give the reception desk the reg details when entering the car parking area however there is no reception staff during the times the car was parked in the space. not sure if this helps any?

    Was the driver actually staying at the YHA, or just using the car park while doing other things?

    [FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, or to all likely candidates now, it can cause the scammer extra costs and work, and often, if they know an MP is in the loop, they will cancel the charge..

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
