Are the signs larger than the required minimum? Have they complied with POFA to transfer liability? Does the landowner contract allow them to operate as they are?
Is the land subject to byelaws? Is it relevant land? Are the signs illuminated? Was the BPA code of practice followed?
If the answer to any of those is no then you have firm grounds to appeal.
Either find out all of those and tell us or send an appeal and see what they come up with.0 -
I would just send the appeal anyway.
As waamo said earlier, send the already written for you blue text template appeal easily found in post #1 of the NEWBIES thread.
Send it unchanged - no additions or alterations needed.

(i) pay the unpaid parking charge; or
(ii) If you were not the driver of the vehicle, to notify us (in writing using the driver identification form on the reverse) of the name of the driver and a current address for service for the driver AND pass this Notice on to the driver.
Please be warned: That if, after the period of 28 days beginning with the day after that on which the Notice is given (i) the amount of the unpaid Parking Charge specified in this Notice has not been paid in full, and (ii) we do not know both the name of the driver and a current address for service for the driver, we will have the right to recover from you, so much of that Parking Charge as remains unpaid.
Additional charges may be recovered from the liable party if debt recovery action or court proceedings become necessary. This notice is deemed to have been given to you on the second working day after the date of sending above.

I've visited the site, and it was littered with signs, and I easily saw the ANPR system that took the pictures.
I want to send the template of, the PCN says I need to specify a reason for appeal. I'm not sure the driver has a reason to appeal.

If you are doing this online (as we recommend, not by post) then if they want you to tick a 'reason' box tick OTHER or whatever box doesn't say daft staff like 'I didn't see the signs' (NOOO!!) and thereby blabs about being the driver!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
