CEL witness statement received - case going ahead?

    Courts have printing limits and can be costly , if you don't know why we say deliver a bundle in person to the court , then you haven't read enough court case threads

    Anyone can hand deliver to the court , at no time did I say that you and only you should hand deliver it , just that it should be done

    No point doing all this work and then failing due to red tape and laziness

    A family member could take it to the court.

    Just make sure it is in a neat ring binder type file, all pages numbered, all evidence numbered, with a contents or index page - AND I recommend putting a secure sticker or sheet sellotaped firmly on the file front, saying:

    WS & evidence of the D for claim xxxxxx, re hearing at xxam on xx/xx/19.

    That is to stop clerks filing it wrongly! You want the Judge to have a really clear & easy file.

    It's not a maximum daily rate, it the maximum allowed for half day's wages/salary or a half day's annual leave to attend the hearing.

    Make sure you take wage slips to prove income level. Include in your cost schedule which you should send to the court and solicitors a good few days ahead of the hearing.

  • I appreciate all your advice - i'm limited it what I can do. How much of an issue is it being handed in on Tuesday? I could ask my Mum to do it on Monday but in an ideal world I wouldn't want to - it'll be about a 3 hour round trip for her and I'm not aware of her plans.

    I've already submitted the cost schedule to the Claimant with by half day rate at £95 which is a bit in excess of what it actually is. Do I just submit another one to them?

    I have no idea what your deadline dat is , its on your court order

    your court bundle needs to be with the court by that due date , be it posted and delivered , hand delivered (preferably) , but even if they accept email dont expect them to print out your bundle for nothing, that would be cheeky and they do have charges and limits on printing

    you can issue a supplemental costs schedule if you wish , the point is dont try an ambush on the day, get it to both parties asap
  • Redx. I'm already late. It was due in on 4th. I was originally given misinformation from the court helpline (back on 22nd October) that the case was going to be thrown out because CEL hadn't paid the court fee. I was surprised when i got the WS from CEL last Saturday - I thought it was all over.

    so why are you leaving it until next tuesday when it should already be in ? get it done tomorrow , with an apology letter to cover the lateness - dont tell us , tell them

    I phoned them again on Monday but this time around I was told while their system shows no payment it turns out it doesn't mean no payment has been received. I can't speak to the court directly - only the helpline and they can never get through to the court.

    The problem is my local court is getting close to 77 days behind on admin so basically no one knows what the actual situation is with any of the cases.

    well there you go then , even more reason to hand it in tomorrow (delivered by anyone at all) and obtain a court receipt or name of the person receiving it on behalf of the court


    if you can email it , do so , putting a note on it that the paper version will be handed in asap
