Sent Nintendo switch for repair - nintendo said they received empty box and refusing to help

So I sent in my switch to Nintendo for a repair as it developed a fault and stopped working..

Nintendo supplied me with the returns label and I attached it to the box and sent it off with the switch.

2 weeks later they email me and say that the received and empty box.

I then go back and fourth with them via emails puzzled as to what has happened... As I definitely sent them the switch including the charger and some printed dispatch notes. They asked for the proof of postage which I sent them.

They have emailed me today saying they won't be replacing it as they never received anything.. and they sent a video of them opening the box to reveal nothing inside!!! I have no idea what has happened here but I am not happy!!

Surely I am covered under some law here? They are the ones who supplied the label so surely they have to take up the issue with the courier? Which was parcel force.

Any help would be greatly appreciated.

No there isn't any weight on the receipt.
  • Who'd want to steal a faulty Nintendo? Are you sure you put it in the box? Maybe have another look around your house?

Looks like they are covered if you can see it is the parcel you sent and is sealed before they open it?

To be honest the box in the video they showed me looks different to the one I sent. I've told them this.

I have also said I'm going to speak to citizens advice and take it to small claims court if I have too. Why should I have to lose out here? This is my sons switch!

They are going to show a tracked label linked to the box you sent then being filmed opened.

You're going to need to come up with a lot more then "the box looks different to the one I sent them" if you take this to SCC.

This might sound silly but I always photograph and video all high value items I send out (on eBay or for repair). I weigh the box I'm sending the item in and the box itself with the product inside (I video this to prove it). I haven't had any issues yet - fingers crossed - hope you find a satisfactory resolution.

What you are doing would provide zero proof should there be a claim.

What would stop me filming myself putting something in a box then as soon as I stop filming, open the box, take the item out, reseal it and then post it off?
