Oh pull the other one. They magically went from passing data onto a DCA who they sold the debt to to the ICO, who don't deal with individual complaints, agreeing with you.

Stop it. Can we have an admin look at these "new posters" who are pulling a complete yarn to bait the regulars into getting banned?

Check again. Are you saying and individual does not have the right to complain to the ICO if a company misuses that individuals data? Look it up, you will find that is one of the main reasons Data Protection legislation was introduced in the first place.

£500 just to tell someone they have the wrong number you’re joking right

Take the £50 and be happy because it’s more than I would expect to get.

You haven’t suffered any losses so move on you’re wasting WAY more time than you need too

You misunderstand. If something not clear, ask and I will try to make it clear.

It is not £500 for telling someone they have the wrong number. It is an amount for the failure of the companies procedures to protect my data.

I would expect you would like to know that the companies holding your data have it secure and won't incorrectly pass it on to any third party without your consent? Would that be correct?

The ICO don't deal with individual complaints, at least not in a manner that the OP is looking for (compo.)

These posts have got to the point of being parodies, OP only wants an apology, but bung me £500 and i'll get over it...

    /yawn

I'm someone who challenges big companies. I enjoy doing it.

I've paid for a service. If that service is not being delivered I will challenge the company. I am in effect asking for my money back for a service that I paid for but was not delivered.

If you data has been mishandled by a company, and in this case proven to be negligent by the ICO, I am entitled to at least an apology and/or a compensatory amount. The amount might be £5, £50 or £500.
  • So an incorrect number was put on another persons account (a simple typing error or of course the customer deliberately gave the wrong number) and people actually believe the guff about the ICO? The energy firm involved wouldn't have even discussed the account as it's not in their name or at their address (now that would have been a breach of GDPR) and nobody else would have been in the least interested.

Can a board moderator please remove this idiotic thread and preferably ban the OP please.

Purely as a one off as I won't be back but what is this mythical service you paid for? Or have you got your nonsense threads mixed up?

The breach is that the company did not ensure the data passed to the debt collection agency belonged to the customer who's account was overdue.

The company did not discuss any details about the other account other than to say they had an account with an overdue amount. My phone details were attached to that persons account which was passed to the debt collection agency.

I'm not sure why you are having a problem seeing that this should not have happened. It did happen and I got demands out of the blue for an overdue account when my account was not in arrears at all.

The point is, had the company exercised correct procedures to ensure that the data being passed on belonged solely to the account that was overdue, I would not have got any demands from any debt collection agency and we would not be having this conversation.

    They did and we are.

If you pay a TV company for TV you are paying for the channels and the service that goes with it.

If you pay an energy company for gas and/or electricity you are paying for the gas and the electricity and the service that goes with delivering these products.

If you pay the water company, you are paying for the water and the service that goes with delivering that water, managing your account ...
    etc etc.

    You get the idea .....

You can complain, but they don't manage individual complaints in the way, for example, the FOS does. And they don't have the ability to make a company give an individual compensation, which is what you appear to be pushing for, despite your claims that all you want is an apology.

I might be in the minority here but I think passing someone's phone number to a debt collector is a fairly important deal. I mean who wants debt collectors ringing them demanding monies you don't owe?

Correct. The will look at a complaint and decide if there has been a breach or not. They will not get involved in any discussion on whether there should be compensation etc. They can fine the company if the breach is severe enough. Not so in this case but they advised the company to update its procedures and retrain the staff.

I did not claim I 'only' want an apology. Reread the thread.
I want an apology AND compensation if I am entitled to it.
    The apology is a minimum.
