Energy Firm passed my data on

OK, let's see now. So we have nothing, zilch, no entitlement etc. Thanks for you replies but I disagree.

For a start, the Information Commissioner has investigated the matter and found that the company did not have sufficient procedures in place to ensure the protection of personal data. The company has been advised by the Data Protection Office to amend its procedures so that the issue cannot arise again. Also, the company has been advised to retrain its staff.

That alone means the company has been negligent. Whether I am after 'compo' or not at this stage is a little bit irrelevant. Actually, I am someone who likes to take on such big companies and make them apologise when they are wrong and to make a gesture compensation if it is appropriate.

So, I started getting demands from a debt collection agency. At that stage, I had no idea how much of my data was compromised, whether my credit history was going to be damaged etc. That in itself was a genuine worrying time. I knew I had no debts but these things have a way of snowballing out of control.

The company said it was a clerical error and offered me £50. I said no and I maintained their procedures were not sufficient, otherwise my phone details would not have been passed to the debt collection agency. As stated above, the data protection office officially agrees with me.

So I do believe the company should, at a minimum, apologise for incorrectly passing on my data.
If I have been impacted by their negligence then I would also be entitled to some form of compensation.

Perhaps those on here could run that by me again as to why I would not have entitlement to apologies and/or compensation given that the company has been proven to be negligent?

What would YOU do in such a similar situation?

    Bore off, entitlements !!!!!!.

Oh pull the other one. They magically went from passing data onto a DCA who they sold the debt to to the ICO, who don't deal with individual complaints, agreeing with you.

Stop it. Can we have an admin look at these "new posters" who are pulling a complete yarn to bait the regulars into getting banned?

Yeah they do. Are you perhaps getting them confused with trading standards, who typically won't act (but can if they wanted to) on an individual complaint?

OP I don't think you'll get the £500. That typically is for instances where the info is sensitive - medical or financial for example. A phone number is neither of those.

Plus, while you may have had fears about your credit history, they were entirely unfounded. You having a belief something would happen doesn't entitle you to damages for it. For a start, it was an account in someone elses name.

It’s a bit of a mystery why you posted the, if you already know the answers and just want to disagree with a consensus view.

Good luck upping the compo, but is it really worth your time?

£500 just to tell someone they have the wrong number you’re joking right

Take the £50 and be happy because it’s more than I would expect to get.

You haven’t suffered any losses so move on you’re wasting WAY more time than you need too

The ICO don't deal with individual complaints, at least not in a manner that the OP is looking for (compo.)

These posts have got to the point of being parodies, OP only wants an apology, but bung me £500 and i'll get over it...

  • Why is anyone taking this nonsense seriously?
  • Are you saying the energy company issued a deadlock letter to you in respect of an overdue account belonging to someone else? I can understand the phone number mix up, but couldn't the energy company tell your account was ok?

Just realised - they issued a deadlock re your complaint about the phone number mix up?

So many replies, I will try to respond to all.

Yes - they incorrectly passed my phone details to a debt collection agency. I complained and they said it was a clerical error and offered £50. I did not accept that and they then issued deadlock letter.
I went to the Ombudsman. The Ombudsman said it was not in their area and it was a Data Protection issue and so Ombudsman referred me to ICO. The ICO has now come back and officially stated company was in breach of GDPR policies.
  • Bore off, entitlements !!!!!!.

Sorry about that ...... one possible solution to your boredom problem ....... avoid this thread.

    Hopefully that will help :)
