Adequate maintenance visa help CA

Hi

I’m looking to marry my South African fianc! next year and we will subsequently be looking into getting him a visa to come and live here in the uk.

I’m in receipt of carers allowance therefore will just need to prove adequate maintenance.

I do not work as I care for my disabled daughter and I’m in receipt of universal credit. I have two children including my disabled daughter I also have an older son who lives with me. My fianc! has no children.

I have savings of 2.5k

Is there anybody who can help me work out of if my income is enough to cover the adequate maintenance part needed for the visa?

A number of SA citizens do not need a visa as they have the right to apply for British Citizenship through lineage. Have you checked that first?
Unlike some here, I am not omniscient. If I am wrong correct me. I won't take offence.

Yes we’ve looked into this and his missed out by one generation as it’s his great grandfather who was born in the uk.

I get the impression that the OP has already identified their route but is unclear how to meet the 'adequate maintenance' requirement which is a concession on the normal financial requirement rules because OP is in receipt of CA.

As I understand she has to demonstrate that she has sufficient income/funds to support herself, child and partner such that after income tax, National Insurance contributions and housing costs have been deducted, there is available to the family the level of income that would be available to them if the family was in receipt of Income Support

    See https://www.gov.uk/government/publications/chapter-8-appendix-fm-family-members
Refer to Appendix FM Section 1.7A. Section 3 sets out how the calculation is to be carried out.
Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

[STRIKE]Hi sorry the link is not working[/STRIKE]
  • Hi calcotti

Yes that’s correct I’ve looked at section 3 and can’t see in the calculations Mr X benefits only employment income

I’ve read all benefits are included I hope that’s correct
  • I think I’ve worked it out.
I combined my universal credit plus carers allowance and deducted the housing costs and it totals to just above the amount a family of four would need to live on. I didn’t add my savings.

    Are you getting child benefit?

Section 3.3 describes how savings that meet the qualifying conditions can be converted into an income figure.

By ‘the amount a family of four would need to live on’ do you mean the amount that your family would be entitled to if you were able to claim Income Support? You can find current rates here https://www.gov.uk/government/publications/benefit-and-pension-rates-2019-to-2020/proposed-benefit-and-pension-rates-2019-to-2020#income-support
