Returning Currys Monitor

Hello.

I purchased a Computer monitor from currys 13 days ago. It was an online purchase.
It's a 4K monitor, there's nothing broken it just that I've had a change of mind and would like to buy a different one.Therefore I want a refund.

Unfortunately, I don't have the original packaging.
But I have all the cables and items which came with the product.

Currys are telling me I'm not entitled to a refund because I used the monitor.
On their website it says "An unwanted product can be returned for a full refund within 21 days of delivery as long as it’s still in its original, unopened packaging."

But according to CCRs: "In the EU you have the right to return purchases made online or through other types of distance selling, such as by phone, mail order or from a door-to-door salesperson, within 14 days for a full refund. You can do so for any reason – even if you simply changed your mind."

And: "A deduction can be made if the value of the goods has been reduced as a result of you handling the goods more than was necessary." - They can make a deduction for packaging.

Currys are saying I'm not entitled to a refund because I turned the monitor on and the product is now unsellable.
I understand what they mean, but how can you judge picture quality without turning the screen on?

What do you think? Do I have a chance at this?

    If you want to check the quality you go in store.

    You are not going to get a full refund. How much was it?
  • The 21 day returns policy they refer to is in addition to your statutory right of return and not in place of it so they are perfectly entitled to state that the goods must be unopened.

    They are complying with their legal obligations as further down the page you refer to, the following is stated:
    Separately to the 21 day policy above, and in accordance with your rights when you purchase goods online or over the phone, unwanted items can be returned even if you have opened them for inspection as long as you let us know within 14 calendar days from the day after delivery. Once you have told us you want to return an item, you should do so without undue delay and not later than 14 days from the day on which you informed us of your decision to cancel the order. You can examine the goods as you would in a shop but to obtain a full refund you must not start using them, install them or input any data/software. The goods must be returned in ‘as new’ condition and in their original packaging.

    Even without the packaging being returned, they can't legally refuse a refund but as you have already stated, they can make a deduction to allow for this and any deduction made can be up to the full price paid.

    I normally buy stuff in store but I thought the returns policy was better for online purchases.

    I don't mind a partial refund.
    But making a deduction up to the full price sounds like abusing the rules.

    Without the packaging then a deduction of half the price is quite feasible. 2nd hand without packaging then they might get £100 if they were lucky

    Speak to them again and ask for the refund, explaining that you understand they can make a deduction. However, you may need to temper your expectations of what a reasonable deduction might be. How much would you pay for a monitor that has been used once and comes with no packaging? I don't know but perhaps £150 give or take? That might be all you get back for it.

    I have a similar problem getting a refund on a phone and would be interested in how your problem was resolved. Did you get a refund and did Currys make a deduction.

    I agree.  When browsing on my phone, or on an iPad in portrait orientation, you can't see the date of posts.

    That's too bad. I was keen to know the outcome. It's like reading an Agatha Christie novel, finding the last few pages missing and never finding out the identity of the murderer..
