    Now it's with powerless debt collectors, please read the NEWBIES FAQ sticky, post #4, which will explain exactly how to deal with them!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    No-one on this forum could possibly think after reading post #4 of the NEWBIES THREAD about ignoring debt letters and laughing at them. You DO NOT risk a CCJ by following our advice to the letter.

    You will get a court claim and we will help, this year, and you will learn loads. No risk of a CCJ or anything as long as you do not miss court deadlines.

    No-one comes knocking, no-one trying to get your stuff.

    You haven't really engaged with the process so far. I understand that all the info. here can seem overwhelming but, the thing is, it's damn good. The most experienced regulars - ditto.

    You did start by resenting being scammed for 5 minutes! And you were right to feel angry about that.

    What would make me even angrier in your position is that the debt collectors will try to make you think you're facing the prospect of bailiffs calling - more vile scamming. But this cannot happen. The only way it would is if you were to lose in court and then fail to pay up within the time frame.

    Cup of tea? Pint of beer? Chocolate biscuits? What would help you chill out and read the Newbies' thread calmly, taking notes as you go? Worth doing a bit more digging around before deciding whether or not to cough up.

    Yes it's panic - but you see these TV programes where they scare you with this propaganda - and I know thats the point - but I don't have money to relinquish to these fools or a court

    just to be clear - and it's hard to swallow that a one size fits all approach works in these circumstances, when so many PP companies seemingly exist and make a fat living out of it - you're saying that it's OK to ignore the debt collectors letters - and only do something when the court letter start?
    and then I can produce something from this website - written/or in representation that will clear me of this "fine"?

    Loads - tens of thousands - go to court each year, and that's why I encouraged you to read the threads where I clearly said 'see you in 2020 WHEN YOU GET THE INEVITABLE COURT CLAIM...' 

    You were advised to read other threads, yet you were not ready for the inevitable debt collection drivel letters?

    LOL, you are just at debt collection stage of ignoring those letters.  Spare us the time to handle the court claim thread, please, and read some.  You will need us WHEN you get your claim, and there is no CCJ risk and no huge costs at stake. 

    PLEASE, PLEASE, PLEASE come off this tiny weeny thread and read the forum posts about court & how to win!  
    NATIONAL PARKING ENFORCEMENT are easy enough to beat, they usually use CIS to send another letter (PLEASE NO POST ABOUT IT) then a robo-claim solicitor to start a meritless claim. 

    You don't seem to have read any other defence/court threads and seem to think that there will be no court claim.  There will.

    We win them.  This is why we tell you PLEASE just read some claim threads!

    You can respond at LBC stage (not CIS, and certainly not TNC).

    You will then defend the case with our help and if a hearing continues it will be at YOUR local court and they are a great experience!

     Yes that's pretty much it, ignore the so called debt collection guff ( its not a real debt anyway) however you shouldn't while away your time sat on your !!!!!! waiting to see if court documents are issued - and for the umpteenth time, this is not a fine.
     You have someone saying you owe them money, you say you dont. They can not prove you owe them the money until they have taken it to court - and even then there are strict rules on what they can and can not claim, if they overstep the line then the amount owed from you to them will be zero, and even possibly a minus figure- that is they will owe you.

    Things you should be doing at this stage:
    STOP worrying, see this as a process - dont play the victim these company's use bully tactics /scare tactics to try and make people pay up, you should see it as how dare they demand money from me? the deeper you dig into PPC world, the more you know and the less likely it gets that you will cave in. Panic/worry and stress all lead to knee jerk reactions that can be bad for your wallet/self esteem etc etc.

    Whos car park was this? you should really be trying to find the landowner - a landowner cancellation will put a stop to this, likewise a statement from the landowner / whoever car park this was/is stating that they would like to cancel  and/or they dont supported their agents pursuing this matter should kill any court action stone dead - or at least give you the upper hand ( by quite a margin) allowing you to claim unreasonable behaviour against the parking company Before you engage with the landowner, please post what you intend to say on here+let us know who it is as this will help determine what strategy to take

    Read and research, you should already have seen the £160 fee, in itself this raises a few questions, search for abuse of process

    Communicate: before sending anything off, post it up on here, if you get a cancellation form the landowner, or a statement that hey do not support this matter going forward/would wish to see the parking charge cancelled - pass this on to the parking company  without permission form their principal they can not pursue you in court - you should also open up a dialogue with the landowner - do they have a facebook page/twitter etc? post it to them on there - you may find some stuff about corporate social responsibility, the actions of a PPC will more than likely fly in the face of this
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
  • OK - now I've got the notice of intention to instruct solicitors
    and they state cases at the bottom of the letter where they have taken drivers to court and won  - saying parking charges ARE legally enforcable in the UK

    Have you read and understood nothing of which you've already been told? Please lose the "helpless victim mindset" ... until you do that then there's nothing any of us here can do to help you - if you won't listen to us (and act on the advice) then further responses will be pointless.

    Sorry if this seems harsh but it's true. The forum is too busy to hand-hold everyone.
