Entitled to a refund? Gaming chair.

Okay so my comfortable, worn out, broken down desk chair of many years finally bit the bullet and fell apart on me so, after some deliberation, and because I enjoy my gaming in comfort, I ordered myself a X-Rocker gaming chair from Argos (the X-Rocker Office Gaming Chair in Black) as it was reasonably priced and had same day delivery (It was necessary, had no other seat I could have used at my desk) so it arrived and I spent 45 minutes assembling it was fairly happy with how it looked.

But that was before I actually sat in it for any length of time. The site claims "Fully adjustable, the tilt, swivel and lock mechanism makes sitting in this chair pure pleasure." I can tell you, that's a lie.

I'm not exactly a big guy (I'm 5'6 an 13 stone) but I'm not a kid either, and this chair certainly didn't seem like it was marketed towards such. But it certainly should be.

After less than 20 minutes I was having to stand up and adjust myself constantly because the raised wings or edges (Solid and fixed in place) forced my legs together and caused me some serious discomfort in the groin area.

I persevered and kept on for several hours before actual pain drove me to seeking out a pillow to sit on, just to raise me above the height of the 'wings' and allow me to sit in the chair with some degree of comfort, but now I'm getting a sore backside and back from the pillow as it doesn’t provide the same degree of support the seat itself would.

My question is, would I be entitled to a refund for this item on some grounds, or is it just a lost cause and I've wasted money on a piece of rubbish?

Thanks in advance.

If it was a distance sale (sounds like it was), you can return it for a refund. Make sure you haven't damaged or worn it and put it back in its original packaging.

Was bought online, but it's been open and assembled and as far as I know a straight up return requires the item be unused, in resalable condition and, as you said, in the original packing.

And while I have the original packing, the screws etc all had to be cut out of the plastic/cardboard holder they were in, ergo not in original packaging, so likely not in a resalable condition or considered unused.

That's why I'm curious if there's anything outside that which could entitle it to being returned and refunded.
  • What Duck is talking about is outside that - he’s talking about your statutory rights not Argos’s return policy.

    You say you arent large.
However at your height, you arent going to be a waife either ;)

Having owned many chairs. The seat width is a major factor for comfort.
Yours is listed as "Seat size W40, D47cm."
The seat Im currently in is"Seat W51, D51cm."
You need to buy a seat that suits your build

Edit: this is the exact chair I bought. However they are crazy. I got it on a deal for £39.99
I would say its a decent £80 region chair

Okay so I spoke to Argos and they aren't willing to do anything about returning or refunding it unless I can disassemble it undamaged (A near impossibility since to assemble it I had to slide the faux leather between two metal rails and even doing that was scuffing the material, taking it apart would certainly shred it)

Below is how helpful Argos was(nt) in this matter.

    1. Yeah, I bought the chair online yesterday and got it last night, and after finally getting it assembled, I’ve discovered that it’s not any use. How would I go about getting this sent back and refunded because it’s not at all like I expected or even fit for my use.
    2. K

are you able to disassemble it and put it back in the original packaging?
    3. To some degree I'd say yes, though I didn't want to do that due to the possibility of actually damaging the chair itself.
    4. K

      One moment please...
    5. K

We can only accept items back under the 30 day money back guarantee if they are unused in the original packaging so if you cannot disassemble it without damaged it cannot be returned sorry.
    6. If I was to disassemble the chair, the chance is high that it would rip the materials off from the sides because of how the chair fits together. The chair isn't fit for purpose because it can't be sat in for any length of time without causing considerable discomfort.
    7. K

      Thanks for your patience…
    8. K

I am really sorry if you check our terms goods can only be returned as not suitable if un used in original packaging so on the basis you are telling me if cannot be disassembled without possible damage caused to it I cant accept a return on it.
So, anyone know what I should be looking at doing now? Or am I stuck with a chair I can't sit on without bashing my bits?

You need to be clear, are you saying the chair isn't fit for purpose or that you just don't want it?

There is a huge difference and your post directly above mine seems to suggest you don't want it...."I’ve discovered that it’s not any use"....?

When I say "I’ve discovered that it’s not any use" I mean that I literally can't use it because its not fit for purpose, which is sitting in.

If I sit in the chair, without adding a pillow or cushion to it to raise the height, I have to sit with my legs squshed together because of the 'wings' on it, which cause certain parts of me to become pressed together and result in considerable pain and discomfort. And adding a pillow or anything to it ends up causing me to get a sore back and backside.

I love the design of the chair and its functions, and if it didn't have the stupid wings I'd not have any issue. I mean why the hell would you put metal wings that force a person to sit with their legs tight together on something designed for comfort and gaming.

This is the important part. It is fit for purpose (as you can tell from the many many positive reviews online) it's just not suitable to you.

The measurements of the chairs are put in the details for a reason.
I have a skinny PC gamer mate in his 30's,your height who would fit in that chair no problem.
Its designed for people who require a seat that size.
