Operator under IPC code failing to address appeal points

  • Has anyone heard of PARKING ENFORCEMENT DEFENCE SOLUTIONS I only ask because they are online and offer free phone advice. I really appreciate all the information and help supplied to date but I am anxious and I'd like to talk to someone about this. Has anyone heard of this group or used their advice?
  • It was VCS and I read it on the rules for posting on forums not to mention companies or people etc.
  • Sorry for the poor quality of the presentation, I've tried to tidy it up and now I'm using the default Times New Roman font provided by the forum editor. Have I improved the posting enough to give you reason to respond?

    Not heard of them myself, but did a search on Companies House but not listed as either ‘Fair Parking’ or their t/a name ‘Parking Enforcement Defence Solutions’.

    They have a website (which no doubt you’ve viewed), but it does, to me, have a tumbleweed look about it.

    They have FaceBook page, but no posts there for well over 2 years.

    You have a phone number for them, it’ll cost you nowt for an exploratory enquiry, but be aware, that we have found no private appeals company to be as successful as the forum, and there have been many unhappy customers.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    You are talking here to the people who know we just won't give you a phone number for obvious reasons that these things CANNOT be sorted over the phone and it is a complete and utter waste of everyone's time to even offer one.

    VCS along with other PPC's do trawl the forum but it's not a problem, even if they do identify you from your posts.

    VCS never cancel after an appeal and going to the IPC's IAS is equally futile as despite their name they are not independent.

    You only have two choices, pay the PCN's or fight them and their inevitable court claim that will come, which with help received from here you have a very good chance of winning.

    With 3 PCN's at I'm guessing £100 a pop (or have they added an extra £60 to each of them?) it's a lot of money to be handing over to the scammers. No one on here would advise paying them.

    As they are relying on POFA to pursue for the parking charges the have to strictly comply with all the requirements of POFA. There is every chance they will slip up with that.

    You say there were 3 PCN's over a 2 day period. What were the 'period of parking' times and dates stated on the PCN's and what were the issue dates of the PCN's? Also were there 'tickets' placed on the vehicle's windscreen?

  • Dear forum members,
    I went through the process required by the operator, I know you all said it would likely be a waste of time, but I followed the rules and of three parking tickets all issued for parking in a space that was allegedly not for parking I have one appeal not contested/withdrawn by the operator VCN, one appeal refused by the IAS and waiting for one appeal outcome.

    I expect that the next step they will take is to threaten me with court proceedings. As I understand it they must prove that I had entered into a contract with them and that on my part I must prove that a contract was not formed because the signs were so badly worded that they were unintelligible and so could not form part of a contract that could be enforced. In addition the signs had no lighting at all and had contradictory information on the same sign.

    Does the fact that they broke their own IPC code of practice not actually count for anything? It clearly states that they cannot issue a parking ticket on a new day within 12 hours of a parking ticket being issued for the same offence on the previous day in the IPC code of practice but the IAS do not consider any breaches of this code of practice. Apparently they only consider the law of contract? So who can you complain to about an operator not complying with the IPC code of practice?

    Is it still too early to start preparing for a court defence?

    What are the next steps please?

    I'm slowly following the processes but your comment about there being no CCJ risk is very interesting can you outline why that is? I'd have thought that if a case went to court that the result would be an order to pay and then a CCJ issued?

    Complain to the IPC - but expect no comfor. They are the parking companies trade body.

    You could complain to the DVLA, but they'll likely tell you to complain to the IPC. But you could try the DVLA.

    There are none, unless/until you receive a Letter of Claim and/or formal court papers.
    Is it still too early to start preparing for a court defence?
    Until you know what their 'Particulars of Claim' are, you'd be flying blind in drafting a defence at the moment. But you could do some research and preparation by reading the NEWBIES FAQ sticky, post #2, so you know what you might expect, and read the 17 defences linked to get an idea of how to formulate your own defence (should it be necessary).
