Letter of claim received from DCB Legal

I am very new to this so please bear with me, i have read most of the threads but my situation seems different so i wanted to start a new one to get advice.

I moved to a flat back in 2017 and upon moving there started parking behind the property where there was a sign stating that it was a residents parking only, ( one parking solution) but the sign was not clear. Not so long after that i noticed a sign stating that you needed a permit to park on the property and to contact the land owner to obtain this.

I contacted the property owners rep whos details had been given as the first point of contact. I was told that they did not issue permits and that i should contact the council. I called peacehaven council and lewes council who both informed me that they did not issue permits as it was not a parking controlled area.
I called back and the rep had nothing to say other than “well we dont give permits” . This was all verbal

I continued to park at this property and then a week later i got a PCN from one parking solutions which had the wrong number plate so i ignored it and then i received a letter two months later asking me to pay £100 i called to argue that i ignored it because the registration number had been wrong.

I was told by a rude lady that she was aware and that they looked at the pictures taken then they corrected it in order to get my details. I made a payment agreement and paid my first instalment

I must add that i suffer from very bad depression and anxiety so and my memory is not always good plus my carrer, at the time was taking some time off so i was left with my daughter (one year old toddler on my own) . I got the pcn in January and they contacted me around march.... fast forward to June and i received another pcn but this time there was not 14days option or a pcn left on my car they just went ahead and sent me a £100 fee i called them and told them that i had no idea about this charge and that this was the first time i was hearing of it.

The lady said well you know your not suppose to park there, so i called the rep again and she told me over the phone that as far as she was concerned the contract with them had expired in august the previous year and had no idea of them still being there.
I called one parking solution telling them that they had illegally given me a ticket when the contract had ended, only to be told that they had been instructed by someone other than the lady in question to start again.

I have email correspondence between myself and the lady as she understood the misinformation and i was advised to appeal the charge which i did. And then i got another two PCNs one was for when i was unloading my shopping and the other one the following day at 10pm as i had been away. Anyway i had no 14day option for any of these charges, when i asked one parking solutions told me that they are not legally required by the dwp to leave a pcn on my car so i had to pay this £300 as my appeal was rejected.

I moved from this property as it was emergency accommodation as my child and i were homeless i was given three days to move so i did. I had no time to do anything even redirecting my mail was not possible.

Fast forward two years later i have just got a letter of cliam from DCB legal with the generic wording, i no longer own the car in question as it was giving me too many issues so i sold it. They have added £60 to each pcn including the one that i paid part of making it £160 they are claiming £640 when in reality the amount would be £350.

I requested meeting between the landowner and one parking solutions back in 2017 and never got a response so now i dont know what to do. I am still recovering from a suicide attempt earlier this year where i was in intensive care. And all this is sending me right back there please help.

    Where did this happen. One Parking are plain plebs and DCBLegal are breaking the law

    Also you may be disabled under the Equality Act, (you do not have to have a BB), I suggest that you seek the help of your MP.

    I have been reading about the equalities act, and i have spent time with someone to go through the BPA code of practice. Which gives them the right to do anything basically there is no protection for drivers. In my opinion its the BPA that needs to be abolished as its just a group of these cowboys who have come together to regulate themselves and there is no legally binding precedent which questions their policies or brings them to task. The new bill although it has received royal assent has not been drafted yet so who knows what they will do in the mean time with no code of practice in place.

    I contacted my mp and was more or less told that there is nothing that they can do as they are not able to help individuals (take on individual issues) as they are already dealing with one parking solution who seem to be living the high life due to the BPA code of practice. I am not even sure that any judge will even listen to me i mean with everything that is going on they are still finding in favour of these companies.

    Actually, they have quite a few hoops to jump through, and we beat them all the time. However, it is not painting by numbers and you do have to read and understand the law and put in the hours.

    You seem to have made a good start so keep at it, you might even get to enjoy it.

    Let me help you write a counter claim as well as a defence. It's free, we do this for nowt.

    I'd like to try for a counter claim to get your money back for the scam PCNs you were not suppose to pay at all, and there are some friendly Judges at Brighton Court these days.

    LOL you have no idea!! The opposite is true.

    OPS are losing cases pretty much all the time, from cases we see in Sussex Courts! ParkingMad goes and watches them lose, for fun, and if you like you can go with her to see how it pans out and prepare for your own case.

    And I can speak for you in your case, if you wish, as long as you attend with me.

    Judges are well aware of the money grabbing practices of these parasites and most will lean over backwards to prevent them scamming members of the public. With CM on your side your chances of a good result will be hugely increased.

    Hello sorry for this i didnt pay the £300 as i was hoping that the landlords rep would resolve it but as they were shady anyway she didn't do anything.
    As i have lost all the paperwork i have contacted one parking solution with a subject of access request to see if i can get copies of the tickets i am seriously considering giving up because i have asked my bank for statement from 2017, and i cannot locate the payment to them i am now thinking that i may have used my now closed bank account to pay them. So i have no legal leg to stand on i will just try to dispute the £60 charge and and maybe pay the rest slowly i dont know what my options are really!
