I am a newbie to this and have followed the instructions on this forum to appeal against this PCN which I received on the date stated, I sent in the template and this is the result I received

Thank you for your letter of appeal. The details of the Parking Charge Notice are as follows:

Car Park: - Manchester
Breach of Terms and Conditions:
No valid pay and display/permit was purchased
Having carefully considered the evidence provided by you we have decided to reject your appeal for the following reasons:
 The car park is operated by Automatic Number Plate Recognition (ANPR).
 Cameras capture an image of vehicles entering and leaving the car park and calculate their
length of stay on site.
 When purchasing a pay and display ticket, you must enter the correct vehicle registration
mark (VRM) and this information is directed to the camera system.
 I can confirm that no pay and display ticket matching your VRM was purchased at the time of
the terms and conditions.
 The signage is clear, a valid pay and display ticket must be purchased for the full duration of
your stay on the car park.
 In the event of any pay and display machine being out of order it is prudent to check for any
other machines on site and obtain a ticket from an alternative machine or sought alternative
parking (there are 2 machines on this site - Pay by Phone on signage).
 I can confirm the parking charge notice was issued correctly and remains payable.
Please make payment of the discounted amount of £60.00 by visiting our website or use the automated telephone service Xxxxxxxxx Alternatively make your cheque payable to (to include a £2.50 handling charge for cheque processing) and post to xxxxxxxxx, quoting the PCN number on the reverse of the cheque.This amount is now due and the charge will be held for 14 days to allow time to make the payment. If payment is not received by this time the charge will increase to £100.00 and this may also result in the notice being passed to a third party with further charges applicable.
You have now reached the end of our internal appeals procedure.
You can make an appeal to the Independent Appeals Service, POPLA (Parking on Private Land Appeals) using the unique POPLA Reference code provided above. Please note, should you decide to appeal to POPLA and your appeal is subsequently rejected, the option to pay a discounted amount will NO longer be available and the FULL AMOUNT of the PCN will become due.


Please note - if the ticket was issued in SCOTLAND and or NORTHERN IRELAND, ONLY “THE DRIVER” can appeal to POPLA.
If you/the driver decides to appeal to POPLA, you will need to visit the website, where further details of how to appeal (either online or by downloading the relevant forms) can be found. If the driver is unable to access the website, please call us for further information on how to obtain the forms. Please ensure that the POPLA Reference Number as noted above is quoted on all correspondence to POPLA. The driver has 28 days from the date of this letter to submit an appeal to POPLA. If the driver appeals to POPLA, we will suspend recovery activity on the PCN.
Appeals may NOT be accepted if payment is made against the Parking Charge Notice, including any appeals logged via POPLA, if applicable.
If you choose to do nothing, we will seek to recover the monies owed to us via debt recovery procedures and many proceed with Court action against you.
By law we are also required to inform you that the Ombudsman Services provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution services. As such should you wish to appeal then you must do so to POPLA, as explained above.

Before all this happed I sent this email to Eurocarparks as follows

I tried both machines and they would not work I have recorded myself using my mobile as evidence of me trying to use the machines to prove they didn’t work and I left a note in windscreen and I also emailed you straight away I couldn’t download the app on my phone so I was unable to pay by phone either, as my car will have now been registered on ANPR how can I rectify this issue, there was a couple of people who was having the same issues, I have tried every way possible to alert you guys about this, this is my first time parking in Manchester and I am new to this, I couldn’t sort anything out.

Hi I have tried to park at Aytoun street car park , but the machine would not work, I have taken video evidence and left a note in my car windscreen the time was 8:33 am this morning.

    It appears you didn't follow the advice in the NEWBIES and instead gave away the driver's identity in your first email to the PPC.

    However they don't seem to have picked up on this according to their reply to your appeal. They may or may not realise when you appeal to PoPLA, but for the moment assume they only know the identity of the keeper.

    You have a PoPLA code, so use it. Construct a draft appeal using all the template appeal points available to you from post 3 of the NEWBIES. Post it here for checking before you submit it.

    Get pics of the site and signage as soon as possible to support this.

    What happened when you complained to the landowner?

    Don't forget to complain to your MP about this unregulated scam.

    It would also help to reverse the order of your contact with the PPC so that it is in chronological, not reverse chronological order. Please also separate the communications from the rest of your post by using a different font colour or quotation marks so we know which part is to/from the PPC and which part is meant for us.

    Go back to that screen where you found the New Thread button earlier and look for the thread entitled:

    Let's start from the beginning. Have you managed to find the Newbies thread?

    It's not quite as simple as sending a link to a template. You really do need to understand what you are sending and why otherwise you can shoot yourself in both feet.

    It's not particularly difficult but does require a modicum of effort.

    This was just underneath where you clicked on the newthread.gif button, and asks you to read it first before starting a new thread.

    Great. Scroll down (it's a long way down) to the third post. That explains the POPLA process and shows examples of appeals. Sadly there is no shortcut to reading it properly.

    Don't rush it will take a few readings but once the penny drops it will become clear.

    We can't be expected to hop between two threads, if that's what you are asking.

    Who not just ignore ECP, or copy another ECP one and ignore them if you lose?

    How can anyone struggle with POPLA when I've written template points to use like bricks in a wall? We are not even asking you to write it.

    And if it loses, who cares, you won't be paying like a numpty!
