Dominos driver hit me. Insurance just got messy

As it is at the roundabout chances are it will go 50:50 I’m afraid.
However u could argue that u were hit in the rear and therefore accept no liability.
As other posts have said if you have a witness you have a better chance.
Stand your ground, surely the dominoes driver has dashcam?0 -
Nonsense. The rule is actually:At a roundabout you give way to the right, but (in theory) only to vehicles already on the roundabout. Otherwise you'd have to give way to a vehicle 200 yards away if you could see it. In the end we'll all need 360deg webcams on the roof like Google maps.
"When reaching the roundabout you should give priority to traffic approaching from your right, unless directed otherwise by signs, road markings or traffic lights"
Nothing there about it being on the roundabout. And if the vehicle is 200 yards away you have ample time to pull out without any effect on them.0 -
"In theory" meaning "I made this bit up, but I think it should be in there". Anwyay, prove this one wasn't.At a roundabout you give way to the right, but (in theory) only to vehicles already on the roundabout.
A vehicle 200m away isn't going to hit you up the chuff while you're on the mini r'a'b, is it?Otherwise you'd have to give way to a vehicle 200 yards away if you could see it.
Or... and this is going to sound radical... just pause and look and think. In the end we'll all need 360deg webcams on the roof like Google maps.
Two people both thought "Ah, it's only a mini r'a'b, I can pretty much ignore it" and just hit it running. One was to the right of the other.
Highway Code:184 - On approaching a roundabout take notice and act on all the information available to you, including traffic signs, traffic lights and lane markings which direct you into the correct lane. You should
...
* be aware of the speed and position of all the road users around you.185 - When reaching the roundabout you should
* give priority to traffic approaching from your right, unless directed otherwise by signs, road markings or traffic lights
* check whether road markings allow you to enter the roundabout without giving way. If so, proceed, but still look to the right before joining0 -

Why?

Of course you don't have to give way to all vehicles to the right not yet on roundabout. Otherwise you'd have to stop for a vehicle to the right even where it was already giving way to another vehicle to its own right. Or to vehicles hundreds of yards away.
Try stopping at a busy mini Rab in rushour in strict compliance with the idea of giving way to anything and everything to your right and relax in the warm smug glow as chaos reigns around you.0 -

You clearly have no idea what “give way” means.0 -
The HC wording is clear.Of course you don't have to give way to all vehicles to the right not yet on roundabout. Otherwise you'd have to stop for a vehicle to the right even where it was already giving way to another vehicle to its own right. Or to vehicles hundreds of yards away.
Reinterpreting it to absurd proportions to try to prop up what you think it should say is simply pointless.0
