CCJ Set Aside! - I won against BW Legal.

Hi Guys

I have a previous thread on this forum from when I was looking for advice to build my case to put CCJ aside from a parking ticket 5 years ago. My argument was it was sent to old address and I won.

I wonder now how long it will take to disappear off credit report as it’s still there (after one week) and do I have to do anything myself to remove it? Applying for a job at Axa and it’s come up already. Thanks

    Surely that is a question for the court. However, I have read that some credit reference agencies (the free ones) take longer than others (the paid for ones) to remove the judgment. Do you have a copy of the judge's decision to set aside the CCJ? If so, maybe you could use that as proof to any potential employer that you do not have a CCJ.

    When you mention paid ones, thats for those idiots who are obsessed by a subscription to a credit reporting service for a "credit score" which doesn't actually exist.
    All credit file reports are free
    The reason the difference in timescale is depending on when the CRA (there are 3 main ones and one small one) updates your file, this is mainly the case for monthly reporting of credit accounts/bank accounts etc
    However as a rule of thumb it should be off your file within 6/8 weeks.

    There are many ways to access your file from all the major CRA's you dont need to pay a penny to check.

    Just to add you've caused the pesky CCJ to be wiped but you haven't actually won the case yet.

    Don't take your eye off the ball of defending the claim and following court Directions sent to you about what both parties must do next. No paying the scammers - you always have a defence v a PPC.

    Eh? How have I now won the case? By consent it has been ordered for my CCJ to be put aside. That’s exactly what I wanted to happen?

    Also - replying to the guy about CRA’s - I don’t pay, I used to use Noddle and now it’s Credit Karma. I’ve just noticed it’s still there.

    I’ve emailed both the court and the trust online to see if that’ll speed things up.

    Set aside just means the CCJ isn't yet in force. BW legal can still reapply to have the case heard and you can still lose and get the CCJ.

    The CCJ was in force from Feb this year.

    It was ordered by CONSENT which means BW legal agreed to have it put aside.

    Why would they agree to have it put aside any then reapply against me ?? :S

    They agreed to the set aside because, by using an invalid address for the original claim, they knew that a set aside was bound to be granted.

    You are now back to square one.

    Depending upon what the Judge ordered at the set aside hearing, the Claimant is free to re-issue the claim against you - at the correct address this time.

    That's the first time you mentioned it was set-aside by consent, therefore you presumably paid the £100 court fee plus the original invoice to BW Legal (or whoever the PPC is) in which case the case is closed and it shouldn't be heard again. Of course, if you didn't pay the original invoice and (depending upon what the judge said) it could still need defending.
