    hi i have read the pofa guidance and my understanding is that
    if they don't issue a ticket and just send a letter they only have two weeks to do it as they have addressed it to keeper:

    'A notice to keeper must be served not later than 14 days after the vehicle was parked'
    Yes, you are right, but your original question made no mention of POFA.

    my question is when it gets to popla stage do i mention that i paid
    which would basically mean i was driving or do i just fight it on the basis of the keeper 14 day deadline?

    i could but i paid with credit card in my name.
    just thinking forward to a future county court where a judge may conclude i was driving if i produce a bank statemen showing the transaction.
