Is this an LBCCC?!!

I have received a letter from bwlegal on the behalf of Total Parking Solutions Limited, I have ignored previous letters, but this seems like it is an LBCCC, if it's not obviously stated?

Picking the important part from the letter, it says...

"If payment or response is not received by Oct 27th we are instructed to issue a County Court Claim without further reference to you."

Along with that there is legal advice in the letter for me. Now that doesn't sound like a bluff to me? I guess that's my question. I'd rather pay the balance they're asking for than contend anything within the court system.

    Date seems a bit short to be a formal LBC as they should give you 30 days, the letter should contain (or point to where you find) financial forms (which you don't fill in) and should contain the particulars of claim and the proof they are going to rely on in court.

    What is the date of that letter?
    Is it giving you thirty days to pay?
    Is there a Reply Form enclosed?

    If so, then treat it as a Letter of Claim as described in the first few paragraphs of post #2 of the NEWBIES thread.

    Otherwise ignore it - as described in post #4 of the NEWBIES thread.
  • Hey guys, thanks very much, yes the letter is dated 23rd of Sept, so 30 days notice (or a little more).

    There is an information form with citizens advice etc, and also a reply form with various legal option, as well as some kind of debt repayment calculator.

    I think I might just swallow it and pay it, not great as £114, but could be worse. I can't even really remember what is was for now, I guess I was late back to the car and probably deserved it.

    [FONT=Times New Roman, serif]Nine times out of ten of these tickets are scams so consider complaining to your MP, it can cause the scammer extra work.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    That looks very like a LBA/LBC/LoC/LBCCC. Your choice to pay it, depends how strongly you feel about funding this unregulated industry and how strong your case is.
  • I haven't got a case, so I'm going to avoid the hassle, have enough going on. I've stood up to plenty of others that have been unfair or I that I could argue, so one's going to get through eventually.
  • Hi...Please don't just give up...would you give your hard earned money to someone just because they say you owed them it especially if can't remember what's it for?
    I am going through the process myself with advice on this sit and others and have uncovered all these scammers dirty tricks and mistakes, so actually looking forward for them to take me to court.
    Yes there's a bit of research & work to be done, and it's up to you if pay them, but and at the end of the day don't make it easy for them believe me they will make more mistakes than you with their Robo claims.

    I guess not, but if I then sent you an invoice for £150, followed with a Letter of Claim, would you pay that, simply because "I'd rather pay the balance they're asking for than contend anything within the court system"?

    Crazy.

  • Bristol Parker...here iis just one bit of how these scammers work and what I found after they eventually sent the information requested as it was over 2 half years ago when they last sent me 2 LOC then just decided not to follow it up when I started to defend it as the retested keeper.
    Within 20min of ready their blabla rubbish that the attendant issued the FCN to the Car 44 seconds after the vehicle was observed parked, in fact the driver was still on the site in view the whole time... I don't even Usain bolt could get out the car run and read their terms and conditions (that are in a different location to the pay station) pay then run back to the car...:j and that's just one underhanded tactic they do....
