The sign says it is for drop off and pick up only with a 20min parking limit monday to friday. That means that parking for any time outwith the monday to friday is an offence.I believe you may be getting confused here The bodies you specify have the statutory power to implement the regulations, to monitor that they are being complied with and to issue penalties (normally by a PCN) where appropriate. Whilst the appropriate body (i.e. a local authority) will enforce their regulation by way of a penalty, the issue of that Penalty is only based upon their (or their representative's, i.e. a parking attendant) opinion that an offence has been committed. The only body that can enforce the Penalty is the Court (or other body as Parliament may prescribe for the purpose). The issue of any penalty will need to be lawful and it would be wholly inappropriate if the issuing body were also the enforcing body. If local authorities were the “Judge” as well as being the prosecutor we may all just as well give up now!!
On your submission it would appear that the regulating body could never be wrong or challenged. Everyone is always guilty! However, that is not the situation, there is always the right of “appeal”. Normally in the first instant to the regulator (i.e. the local authority). And, if it is not resolved satisfactorily at that level, to an independant body that could be the Court or as is more normal in Parking Disputes to a Parking Adjudicator. If it is a Parking Adjudicator then it will be a much less formal procedure than in Court and normally common sense is applied in more liberal doses.
I think we're probably both being too extreme. I agree with you about appeals etc. However if it was purely down to opinion, then there would be no need for TROs etc.
Authorities do have a certain amount of legal power, perhaps not as much as i was suggesting, however they must have some power or everyone would simply say, "in my opinion i can park here so i will"
Given that TROs and other legal documents are approved by the Scottish Exec or the Dept of Transport, then there must be some sort of power assigned to authoroties to govern their area on behalf of the SE or DOT.
That's not to say that every warden or every council officer is correct everytime but when they issue a ticket, it is because they have the power to do so in light of the offence committed.
Whether the offence has actually been committed or whether the warden issues the ticket in the correct manner is another issue.

yet another 'controversial' parking ticket one
i have never seen a drop off/pick up area in a station that doesn't have a time limit (near me it's 10 minutes rather than 20) - and i'm often there for 15 mins when i go to pick someone up and the stupid train is late!! it seems very bizarre to me to suggest that the space remains only for dropping off and picking up but that the time to do so is unlimited on saturday and sunday, but that that is different from just using it to park all day......... or that at the weekends it must be kept empty.... please can common sense come into play!
clearly it's a stupid ticket that shouldn't have been issued - i know that there is a hardcore group of people on here who hate seeing others wriggle out of fines for parking, but seriously, this isn't someone who was trying to push their luck, even a parking warden agreed!

Excellent I'm really pleased. They are too quick to give out parking tickets. A guy I used to work with has become Ticket Warden and now he drives round in a Merc!! I'm sure they aren't all that lucky but I'm glad you didn't have to pay out so close to Christmas... WELL DONE0
