Wow. A lot of vitriol towards OP. I love how some people on here seem to be implying that OP was bound by a contract to adhere to the September deadline. This isn't a new build and nothing is agreed until exchange. OP is perfectly entitled to walk away for any reason they choose.
Yup. The discourse on this and other threads veers so often towards being trash that it makes you wonder why people bother commenting. Bottom line is we don't have to like what the OP says but that doesn't mean we have to demean them in the process of responding. Satisfying as I'm sure it is, it's just unnecessary.0 -

I think really, we were just so disappointed to miss out on the house at such a late stage. Linden Homes were of course, well within their rights to withdraw the £5k allowance as we didn't complete in September - we had thought, and so did the various sols, agents involved, that they would still honour it as going back on the market was a bit counter productive. Turns out we were all wrong.
It's been back on the market for over a week and had no viewings or offers


It has caused us problems though, we're going to have to live with family as we doubt our buyers will wait through another conveyancing process. Oh well. The house we're getting instead is much better

I've just wasted 15 mins reading through this thread. Really, all it can be boiled down to is:
- You feel aggrieved by the entire home buying process, like many others
- You feel that a multi-million pound company should give you £5k off by virtue of the fact that they are a multi-million pound company, when the whole reason they are a multi-million pound company is they don't give properties away for free
- You cut off your nose to spite your face, and are now living with family, and the company are none the worse-off0 -

Yup, pretty aggrieved. What a minefield eh! Not only is the house buying process a pain, I also have to deal with flannels like you on here
I never really expected them to give it away for free, so don't know where that's come from. They initially offered £5k, so can obviously afford it. I'm not sure where you're going with this to be honest. They've taken it away as a punishment, there's no other logical reasoning.
Nose still firmly attached thanks - we've found a better house and now don't have mortgage repayments coming out. A bit inconvenient to be living with family but hey-ho.
At least we're not back on the market, in this climate. Paying additional estate agent fees and what have you.0 -

Yep, it's not ideal in either respect. But I suppose that's what happens when you i) move the goalposts and don't complete 'on time'; and, ii) come onto MSE and complain for no valid reason and start accusing posters as working for Linden Homes.I never really expected them to give it away for free, so don't know where that's come from. You pulled out of a house purchase over £2,500 which you're entitled to do so.... as they were equally entitled to do so when they revoked their offer as you didn't abide by the terms of it (completion by September).
Overall I fully sympathise with your situation and would most likely be exactly the same... However I can't see that the Developer did anything wrong, and like I said, it looks like your main issue is that they didn't honour the £5k when they were not obliged to do so.0 -

I think we're largely on the same page actually.
It did come down to a principle really - it felt a bit like they were taking advantage of us by letting the time wind down to the last moment. They waited until we were vulnerable and tried to chance their arm.
I've stated previously they were within their rights to do so. We just thought they would honour it rather than go back on the market again. We were so close to exchange/completion we thought they'd probably just go with it.0 -
The whole buying and selling is a nightmare , I am in the removals business and its pretty common to have delays in completion , I spoke to one of our clients only a couple of hours ago and they didn't know whether their move tomorrow is going ahead or not , this is happening more and more often , 99% of them do go through eventually , we have even have moves collapse on the day . More often then not its down to the solicitor and paperwork
I very much doubt the Linden Homes haven't come across this before , they may just be testing you to see that you are seriousVuja De - the feeling you'll be here later0 -

People themselves need to have reasonable expectations. In this 24/7 world there's far more impatience. The "paperwork" needs to be in order otherwise the lender is exposed to a very significant loss. Likewise the solicitor would lose their practicising certificate and their entire livelihood.0
