Parking ticket from smart parking sea lane ingoldmells

Hi,
As stated my parents recieved a ticket saying they overstayed their paid for time, I contacted smart parking regarding this stating how many hours they paid for and according to the signs they should have paid for 4 hours, however smart parking have replied stating they only paid for 2 hours and we would need to go to Popla to take this further.
My main question is can anyone tell me the parking charges per hour for this car park as unfortunately my parents threw away their ticket (obviously weren't expecting a pcn) as smart parking dont seem to forthcoming with their prices for this car park.

    We don't have price lists, chasing that information is a distraction and of absolutely no use to you.

    You (or more to the point the person named on the Smart Parking letter) must get on with dealing with this. You can do the work on it, but it must go out under the name of the person being pursued.

    Has a formal appeal been made to Smart? If not, you need to be reading the NEWBIES FAQ sticky, post #1 about how to do this - you must get this done by the Smart 28-day deadline.

  • As stated an appeal was made and they will no longer hear anything further, so I now need to speak to Popla in regards to this and while I understand you may not have price lists I was hoping someone local may have been able to tell me, surely if their prices displayed do not match the prices their machines are charging that is not a wasted effort to be used when addressing popla?

    In the popla appeal you use the signs issue as putting the claimant to strict proof of their claim , which should be presented in their evidence pack

    As well as signs , use

    No landowner authority
    Poor and inadequate signage
    Any POFA errors
    And BPA Cop failures

    Etc

    Try Google maps for pictures of signs

    Nobody talks to popla , it's a written appeal

    Do not speak to PoPLA.

    The keeper should use the PoPLA code supplied on the appeal rejection letter to appeal to PoPLA as described in post #3 of the NEWBIES thread.

    Read what Pete Wishart MP said recently in the House of commons about Smart Parking

    "I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.

    The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices."


    Nine times out of ten of these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    With any of this stuff, which can very easily become a legal matter, you must be totally clear and accurate on what you say and/or describe.

    There has been absolutely no statement from you saying the above. We deal with so many separate cases each day, up to 100 each and every day, we cannot risk surmising/guessing/reading between any lines a newbie throws at us, hence the closer questioning on specifics.

    You could try using Google street view to find the car park but you will have to get the post code from your parents as there is no car park in Sea Lane. There is one in Roman Bank (all day parking - £1 on one side of the sign and £3 on the other side!) but nothing actually in Sea Lane.

    And that has the makings of "Wrong location" to add to other points in a POPLA appeal.
