Finally received a letter in reply to my SAR request. Four pages of text, including copy of original PCN and higher resolution photos of first entry and second exit.
However, the paragraph reproduced below says that other footage which would relate to first exit and second entry to have been deleted....
So what to do?
"Lastly you have made a request to obtain ANPR data from what you claim to be two seperate entries and visits to the car park. Please be advised that due to our Data Retention Policies, data which you have requested in only kept for 10 days, unless it relates to a Parking Charge Notice (PCN). Our records shiw that you have entered the car park at 11.53.49 hrs on 29/06 and left at 17:37.48 on 29/06. As you have overstayed the maximum period the Parking Charge Notice has been issued"0 -
write back and give them 7 days to produce it due to the pcn being issued and data should have been retained for say 6 years due to being required if a small claims MCOL was issued in England and Wales , especially as a pcn WAS issued.
You will bring this lack of evidence and personal data up at POPLA or in COURT as required, because they have been shown to be wanting in only providing half the pictures required and you will repoert them to the ICO after 7 days has elapsed0 -
In their letter they also state that Euro Car Parks does not engage in any form of automated processing and decision making. All processing is done by ECP staff who check and verify the ANPR data before a PCN is issued and before it is sent by post.
Presumably the same level of error checking that gets my registration number incorrect at the start of the letter (I presume its a fill in the blanks template and they didn't start from a blank template)0 -
If anpr was 100% accurate ( instead of about 80% accurate ) and if ECP staff did their jobs properly (none of them do) then no PCN would have been issued to you
It's such a common problem that it's banned for councils , plus parking prankster blogged about it years ago , so common it's known as double dipping , but then they would say what they said , wouldn't they ?
