Selling a Flat in Probabte

Im currently in the process of selling a flat which is leasehold and and now the freeholder of the block has passed away and it is currently in the process of applying for probabte , what i need to know as these things can take a very long time can i still complete on the sale of my leasehold flat while this is still going on with the freehold? and if so what are the steps / process for this ?

    Your buyer will want a leasehold pack provided by the freeholder. That answers various questions like whether you have paid ground rent and service charges up to date, whether the property is insured etc etc

    If the deceased freeholder had a will, then the Executer now has responsibility for the deceased's Estate, including the freehold, so can (from a legal point of view) provide the answers. The difficulties might be that

    a) do you know who the Executer(s) is/are?
    b) they may themselves have little idea, at least initially - though part of their job will be to get on top of everything to do with the Estate.
  • Thankyou so legally what would the process be ? in order to try and complete a quickish sale could it still go through if say i offered a bond with funds in to cover until the probate is complete to the new buyer & if they were happy to still proceed ?

    If they are 'happy to proceed' then, fine.



    But most buyers, and their solicitors, and their mortgage lenders, will want to see the pack before proceeding.
