BA reject claim

Anyone experts at claiming compensation for a delayed flight? Never done it before and don’t know whether or not to challenge the answer!

My 20.00 flight from NCL to LHR was delayed overnight and left the next day at 12.00 obviously arriving more than 3 hours late!

Now, BA have said no to my claim saying air traffic control would not let a previous flight land therefore my aircraft suffered a knock on delay! There were no adverse weather conditions that day FYI.

My aircraft actually landed at NCL at 22.30 that night but I suspect the crew were out of hours so had to give them overnight rest whilst the aircraft sat overnight at NCL as well then departed the next day.

Any advice??

    Put your flight details into euclaim and bottonline and see what they say then get back.

    Heathrow curfew will come into play too at that time of night

    Sadly the Bott flight checker will say that for pretty much any delayed flight. I've had claims with Bott that they decided to drop and years later the flights still show up as compensatable on their own flight checker.


    If BA keeps refusing the options are going through alternative dispute resolution (BA uses CEDR), small claims court or a no-win-no-fee company such as Bott & Co.
  • Thanks-do I reply to BA in the first instance? Any tips on what to say? Their official line is ‘Heathrow was unable to handle the number of late arrivals’

    After I’ve replied to BA and they say no again I’ll take it to the next stage but I don’t think I’ll bother taking it to a court!

    If you're taking the case to CEDR you'll need to request from BA that they refer you to CEDR. If you're handing over to Bott you don't need to contact BA again. I see little point in simply asking BA to reconsider their position as it's highly unlikely to change so if you're taking things further you may as well get the wheels rolling straight away.
