Egg Banking Plc restriction at land registry from 2007

I really need some help please? I have a restriction placed by egg on the title of my property in 2007, registered at land registry. I have sold the property and this restriction is holding up the sale. The property is jointly owned and the restriction is solely in my name. There are several restrictions on the title, and my solicitor has managed to contact them all and obtain settlement figures barring EGG. The solicitors that obtained the restriction no longer exist, and they have ceased practicing, all be it under a cloud. The solicitors that obtained the CCJ and registered the restriction at land registry were subject to a solicitors disciplinary tribunal (SDT) and were all given significant fines by the tribunal for serious breaches. Nobody had taken over their practice, and they hadn't merged with another practice. The debt related to an Egg credit card. I would appreciate any help, as this is the final hurdle for the sale to go through. I am at my wits end! Who do I contact to repay this debt? As Egg does not exist anymore!!!

    Yes they do, Egg Banking plc is now part of Citigroup. So I expect they also acquired your debt. It's irrelevant who the previous solicitors were.

    Hi davidmcn. Thank you for your reply. So when Barclaycard acquired Egg in 2011, did they only acquire the active credit cards? Did the debt part of egg credit cards remain with Citi Bank?

    I have no idea, but I expect if you contact one or both of them you (or your solicitor) should be able to sort it out.

    It's also possible that the Land Registry representative here may be able to advise which company is currently discharging such restrictions in practice

    They acquired the entire credit card business, but not the other Egg-branded products.

    So if it was a card debt, then start with Barclays. But one thing's for sure - you know it's either Citi or or Barclays that you need to speak to. Two phone calls, at the outside.

    If the restriction was wrongly applied, as you seem to apply with your comment about the solicitors, then the original creditor will still be able to remove it.

    AdrianC - Thank you for your reply. I have telephoned Barclaycard. I spoke to someone in a call centre who had no details of my name the account number or address. I sent a message last night to customer relations at Barclaycard, asking for someone to get back to me. I'm not sure of the number for Citi Bank? I did ring a number, but went through to the wealth department! I seem to be going around in circles.

    Barclaycard only acquired the active Egg credit cards, hence they won't know you from a hole in the ground.

    You need to contact CANADA SQUARE OPERATIONS LIMITED which is what Egg Banking calls itself these days.

    Hi AdrianC - I don't think there was anything improper in the way the solicitors acting for Egg Banking Plc applied the restriction. H L Legal Solicitors in association with SAMPSON & Co (as per their letter heading) obtained the CCJ and applied the restriction. H L Legal Solicitors of Redditch no longer exists, and Sampson & Co solicitors, are the solicitors that were subject to the Solicitors Disciplinary Tribunal. I have contacted Land registry personally. My solicitor has filed the necessary forms with land registry for removal. This request has been rejected! Obviously my buyers solicitors want assurances that they will have clear and clean title.

    My solicitor has filed the necessary forms with land registry for removal. This request has been rejected!
    Because you can't unilaterally remove it. It'd be worthless if you could. Only the creditor can remove it. And they'll probably insist on you settling your debts before they will.
    Obviously my buyers solicitors want assurances that they will have clear and clean title.

    AdrianC - It's not a diversion! I'm trying to pay it. Please don't take offence or take it personally. Had the solicitors been above board, then they would have merged with another practice, which indeed is what they tried to do, as stated at the tribunal. It was an unfortunate occurrence, because it would have made the matter a lot easier if they were still practicing or had merged, for myself or my solicitor to contact them. Thank you for your help.

    Hi Antrobus, thank you for your reply. I have telephoned Canada Square Operations and they have given me an address and an email to contact them directly. I'm going to email them requesting a redemption figure. Thank you so much for your help and pointing me in the right direction.
