Packaged bank account guidance

Hello,
I recently made a claim for a mis sold packaged bank account. I was sold the account in 2009 over the telephone.
The bank have come back to me to say they will not look into euclaim as it happened more than 6 years ago and also, they sent me an annual reminder of the benefits since 2014.
I went into branch to cancel and was told I would lose my overdraft as a result of removing the account, and at the time I was living in my overdraft so I couldn't cancel because I didn't have the money to pay it back. They have no record of this.
What shall I do now? Is it worth fighting for?

What Complaint Reasons did you give to the bank?
It sounds as if bank are time barring your complaint on the basis that it is more than 6 years since you opened the account and more than 3 years since you should have been reasonably aware you had cause for complaint - the 3 year clock would be started by the first annual reminder of the benefits/cost of the account sent to you in 2014.0 -
So, to summarize, the packaged account account came with an overdraft, when you wished to close the account you decided not to because you needed the overdraft part of the PA, and you are complaining that you didnt need a PA even though it provided an overdraft which you needed ?????0

I don't remember asking for it, I didn't need any of the benefits. When I became aware of the fees and wanted to cancel I was told that I would be downgrading my account and therefore I would have my overdraft taken away. The silver account didn't come with an overdraft or anything.

No.
The packaged bank account came with Travel insurance which I receive through my work, mobile insurance which I had with my contract and breakdown cover, I don't drive.
It never came with an overdraft, I had my overdraft before this silver account was added. But when I tried to remove the silver account I was told that as a result of downgrading my account I would have it revoked.0 -

The timebar is valid. So, you give up.
The banks acted very quickly on PBAs and the annual statement of benefits with a reminder that the accounts are optional allows them to start the three year clock.0 -

So not worth going to the ombudsman then? I really wish there was a way I could prove what I was told by the bank.0 -

It wouldnt matter if you could prove it. You are timebarred. Timebars mean the complaint isnt considered. Even if it is absolutely nailed on.
And yes, there is no point going to the FOS with a valid timebar.0 -
I would complain but only because I do not believe they would take your overdraft away; probably put you on a more expensive tariff (or you have understood perhaps that part of your overdraft is fee and interest free and it is this that they were talking about by taking it away).0
