Drp .. CCJ!

Hi,

I have read a Lot of threads on here but I am confused as people are saying do not pay, DRP will not result in a CCJ. Well I had 5 in total all for parking at work ( I knew I couldn’t park here but as it was private company I was stupidly advised to ignore and parking here would be ok) WRONG. I ignored drp/Gladstone’s for about a year until I received an official court letter in which I had no choice but to pay before resulting in CCJ I then got another court letter so again I paid. Yesterday I received a call from DRP about my further 3 saying they are on way to legal action so I need to pay by Friday to stop this. I contacted drp in July to get this sorted I emailed them twice they ignored me and just rang Me out the blue 3 months later demanding the money straight away.

I am currently on maternity leave and got made redundant in August and my maternity claim still ongoing I can not pay this but do not want CCJ on my account as have a great rating

Where do I stand, how do people get away with not paying these fines !?

    DRP can't issue court proceedings, so for the moment these are empty threats from them. Gladstones on the other hand can issue proceedings so if you get a letter from Gladstones you must come back here for further advice.

    Beware that sometimes DRP use Gladstones letterheads to peddle their misinformation. Just come back if you're in any doubt with any future communication.

    FORGET DRP they are simply low life money scammers.

    Could you explain where and how this has happened and you should not be thinking about paying ...... Gladstones are an incompetent bunch

    You do not owe anyone anything unless someone who think that you owe them money takes you to court and wins. As DRP are not claiming you owe them money they cannot take you to court.

    All such information is available on the internet. Might I respectfully suggest that you do some research as nine times out of ten of these tickets are scams so also consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.
  • Assuming this follows the usual course, CPM are seeking £300 in PCN charges, to which they've added £180 for costs/reasons that they have still yet to properly articulate in a courtroom, so nearly £500.

    Even if you accepted responsibility to pay the PCNs (and I'm not saying you should) a properly crafted defence on the costs alone has potential to reduce the sums by 37.5% instantly and in some cases has resulted in the entire claim being struck for *abuse of process* (that's your forum search term).


    Whatever the position if the o/p, even if she needs to pay them all (and that's by no means clear) each PCN will be carrying a £60 enhancement

    In that case it's CPM not DRPL who have issued the court claims by using Gladstones , who have filed them online using MCOL

    Drpl cannot cancel the charges, which is why they didn't , and CPM don't want to , hence why they told gladrags to issue the court claims

    Drpl do issue empty threats , but once gladrags have issued the court claims you should be defending yourself , same as everyone else

    The CCJ happens when they win at Court , usually paying it promptly within one month expunges the CCJ from the record , otherwise it's there for 6 years, even if paid late

    Never ignore an actual formal LoC

    Never ignore a court claim letter from the CCBC in Northampton either

    If you receive a court claim , defend yourself , do not ignore it

    It depends what these "official court letters" are.

    If they are a letter before claim (LBC) there is a clue in the wording. It's a warning they may start court proceedings.

    If it is a letter of claim (LoC) then it is a statement of fact. They ARE taking you to court.

    If it is a judgement in default then it means they have taken you to court and won. Not paying the court judgement will get you a CCJ.

    None of these should be ignored, so please tell us which you have received.

    You were given very bad advice to ignore everything. That advice has not been given here since the law changed in 2012.

    The advice to ignore debt crawlers is correct.
    The advice to ignore (except court papers) outside England and Wales is correct.
    The advice to ignore nearly everything else is not correct.
