    You put into the defence everything you believe is truthful and could assist you. But you will need to account later in your Witness Statement why the 22 minutes overstay required Grace Periods to cover it.

    Grace Periods are not 'free and gratis' extensions to parking limits.

  • Just a quick update. I am sending the defendants DQ to the court and a copy to BW legal today. The defendant will send a cover letter to BW legal slightly showing her hand in the hope of them ceasing the claim (most unlikely). We shall see what comes back.

    If you're providing them with any chink of light that assists them, why do you think that might encourage them to back off?

  • I'm assuming the DQ and defence statement have already been sent to them by the court therefore they already have the basis of the defence.

    Would it be better just to keep the covering letter short and avoid any attempt at reaching an agreement? I thought maybe a judge would look at that favourably as an attempt to settle the matter out of court.

    WHy are you sending a covering letter? What is the purpose of it?
    The DQ is NOT sent to them by the court. YOU send it to them, as per the instructions ont he DQs letter.

    If you want to offer any amount of settlement you DO IT PROPERLY
    Without Prejudice, SAve as to Costs.

    That title must be used.

  • @nosferatu What I meant is that the claimant is sent their own DQ to fill out along with a copy of the defendants defence statement, is that not correct?
    Noted that I must include that title, is there any other wording that are needed?

    @couponmad that was the general idea. As well as questioning their own process.
