Park With Ease - Lowther Estates

Unfortunately, in my (failed) appeal I wrote that I was the driver. In truth I wasn't, but to keep things simple, I wrote it that way. I have only since discovered I was wrong to do that.

Should I now proceed on the assumption that I was the driver? The letter was not POFA compliant...

    Do you have any evidence you weren't the driver? If it goes to court you may face credibility problems if you can't demonstrate you weren't the driver.

    Have you tried to get the landowner to cancel the ticket?

    Past cases here have shown that Lowther Estates don't entertain such an action.

    Who's car park was it?
    what type of car park was it?
    why did the vehicle attract a parking charge?

    If you were not the driver tell them so. Any assumption otherwise on their part would therefore me incorrect.

    Unlikely imo, I think that a judge is more likely to believe you that an ex-clamper.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.

    Unfortunately the only evidence I have would be a witness statement from the real driver!

    The car park is owned by Lowther Estates, and is managed by Park With Ease.

    My question is basically whether I have now messed myself up badly enough that it is worthwhile just to pay the £50 and be finished with it?

    A witness statement is fine. It's evidence and you have a reasonable explanation.

    I suspect the ticket isn't £50. Are you sure it hasn't gone up, they are usually £100

    Taking you to court for £50 would be madness. It would cost more than they could recover. I would sit tight and see what they do.

    I am sure that Park With Ease where kicked out of some / all Lowther estates ..... if so then a complaint may now work
