So would you rather he just laid the 39 sq m he quoted for? As above, are you wanting the extra 5 sq m ripped up?

Try and get him to come and visit you so that you can demonstrate that only 39sq metres of material has been laid. The difference between 39 and 44 sq m is quite considerable.0

I would pay the quote amount and then send an email saying that you have measured the area of patio and it is 39 square meters, so perhaps he is confused with another job he has done, and if he would like to come and check with you then he is more than welcome to come and remeasure it.Should've = Should HAVE (not 'of')

So you should not be paying any more for either labour or materials than quoted. I believe the technical term for this is 'trying it on'.

No, he can't rip it up. That would likely constitute criminal damage.
Plus in a consumer contract, the trader needs to tell you the total price. If its not possible to calculate then they can tell you how it will be calculated. Any information provided under that requirement is to be treated as a term of the contract.
Remember, the OP told us that the trader measured the area....not the OP. The trader can't disclaim liability for something which was fully within their control and was their mistake.
Also, I realise the OP's more recent post says the area is only 39 but even if he had laid 43, he quoted for 39, would've ordered supplies based on 39 and likely would've ran out before finishing as while you may allow extra for wastage, its for wastage. We have paid the amount of the quote. £6100
We have discussed this additional area and said we will only pay the quote. He seemed taken aback that we didn’t want to pay an extra £800.
I am prepared to pay the materials cost, but as previously stated, his estimater made it 39 sq mtrs and so did I.0 -
