A loss at the IAS could buoy up the PPC to push on further with court action. It could cause a Judge to draw a conclusion that as already two (including one independent) assessments have gone against the motorist, then he might be minded to follow. Possibilities .....Based on reading the NEWBIES thread, the only basis by which it seems it's not worth pursuing IAS appeal is because it could be time consuming and demoralising. Unless i'm missing something it doesn't suggest that i'd experience any additional financial implications or restrictions on further contest whether it be via court or an arbitrator.
Why not PM the previous IAS (lucky dip) winner and ask to see his appeal? I don’t think many here will be prepared to offer time and detailed support for an appeal to the IAS - we are already overstretched, almost to the point of implosion, in helping with potentially winnable POPLA appeals, court proceedings, defences and witness statements, as well as the daily Groundhog Day ‘Help, help, Yelp, I’ve got a parking ticket, how do I get out of it?’!i'd be extremely grateful for your support in helping me to construct my appeal to put me in the best possible position to win at IAS just like the other guy.
I wish you luck. Come back and flabbergast us.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
