Homeless with equity help
Penny_Les
Hi I’m sending this to reach out to anyone that could possibly give me any help/advice to move forward with my life as I feel I’m stuck in a hole and can’t find a way out.
For a month now I’ve been homeless sleeping in a homeless shelter at night with no income or access to benefits.
I spit with my partner of 21 years around 3 years ago , we had a joint mortgage together.
And first after I left iI was paying the full mortgage , then a while later we agreed to pay half each until I lost my job at Christmas and couldn’t keep on paying.
I cannot move on with my life at the moment because I’ve this property with £120,000 equity in it I’m not entitled to benefits so I’m stuck in the homeless shelter unless I can get a job again soon.
I’ve been told my only option is to force the sale on the property and in a ideal world if that could happen I could move on with my life but how can I do that with no funds ?.
I have no dependants at the property and I’ve been told that it would be possible to force the sale due to my situation, I’ve also been told it’s possible to force the sale without a solicitor but I’m unsure how.
I’m hoping that someone would be kind enough to spare me some of their time just to advise me what to do or where to go.

See if there is a local community law centre in your area - They would be able to advise on what options are available to you.Any language construct that forces such insanity in this case should be abandoned without regrets. –

Treasure the moments that you have. Savour them for as long as you can for they will never come back again.0 -
I’ve been to community law also free legal advice from family law . Both say my only option is to force the sale or come to an agreement with my ex . My ex wants to keep the house she can’t buy my share and has no intention in selling and I’ve no funds to force sale so I’m stuck0

Have you looked into legal charities that may help you force a sale? This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

What were the circumstances of you moving out? Violence? Abuse? (on either side)
If not, can you not move back in and houseshare as "acquaintances"? You have as much right to live there as they do!How's it going, AKA, Nutwatch? - 12 month spends to date = 2.60% of current retirement "pot" (as at end May 2025)0 -

True. It's probably easier said than done. But if you've got the courage, you could do this. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Your ex is abusing you and taking you for a fool.
You need to write a letter to your ex that you wish to have the property sold in order to claim your share.
Also inform your ex that you are willing to be bought out, but if that is not an option, then selling is what you want.
Send the letter certified mail.
See if you can find a solicitor who is willing to take your case, the bill for your part of the sale will come from your 50%.
Failing that I would move back into the house which is still jointly owned.
Your biggest mistake was moving out and ex is using that to the full advantage.
You are only going to get somewhere by growing a back bone, yes, its hard and standing up for what is rightly yours. but I have been there, it is not pleasant, but I realized that I had to fight for what was mine otherwise he would have taken me to the cleaners.
Good luck0 -
Do you live in a University city/town? Some Unis with law schools have free advice clinics and may be able to help.0

I’m not sure of any legal charities0

I’m not sure of any legal charities
There's these ones I saw in a quick google search for legal charities:

Have you checked whether this qualifies for Legal Aid?0
