Hi all,
Firstly I'd like to say thanks to the contributors of this forum. I stumbled upon this today and the template and all other information on the NEWBIES thread is really helpful.
Before I send off the blue template in NEWBIES thread and appeal the parking charge notice, I'd like to confirm a few things before I do:
- the PCN is from Initial Parking at Newquay, Fistral beach.
- The PCN date of contravention was day 0. I received the notice (date of notice) on day 12.
- The entry time was 12:00:01 and the exit time was 12:30:00.
- I've looked on the website and I am not sure which of the appeal options to choose from
- I didn't have a ticket. The car park was very busy, and since it was my first visit to this beach, I didn't think I'd get a ticket because I was only stopping and looking at the waves for a short period of time. It took me 10 mins to park as the weather was great.
I guess my question to you is... can I appeal this ticket? What are my chances of success?
Thanks in advance, I appreciate the help!

Don't say any of that in the appeal.I didn't have a ticket. Your chances are pretty good as long as you appeal as keeper.
You would lose if you'd appealed in the way you just wrote to us above!
At POPLA stage, among the other usual points, you can cite the decision shown this week in 'POPLA Decisions' (top of the forum), where an Assessor found that the NTK wording was not POFA compliant. It's not just about the date it was sent.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi Coupon Mad,
What would you recommend the next steps are? I have just received this in the post two days ago. Do I write an appeal now, and if so, do I simply send a copy and paste of the template on NEWBIES?
Best regards0 -
Yes that is right, the whole point is to get a POPLA code. No detail to add yet.
DO NOT tick any box that talks about being the driver/not seeing the signs.
Then do not go away, stay here and read all the Initial Fistral threads, we have several. Practise using the search this forum drop-down and put those words in, and change the default to 'SHOW RESULTS AS POSTS' (never leave it as 'show threads').PRIVATE 'PCN'? Follow the advice in the NEWBIES FAQ sticky, post #1 exactly as written - send the blue text initial appeal template, unaltered. With an ANPR camera capture PCN you can appeal immediately. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi both,
I received a POPLA verification code. The appeal has been rejected and a long letter sent back. What are the next steps?
Best regards0 -

Who sent this letter? Please post a copy.
Please stop asking what the next steps are, the stickies/FAQs give a comprehensive timeline.
Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking CompaniesYou never know how far you can go until you go too far.0 -
OP I made your link live but it contained the POPLA code, so I took it down again. If you redact the POPLA code (or any other personal info) and repost, I (or someone else) will enliven it.
Just post it as hxxps://imgur.com/a/ZuJEWpU or whatever new letter combinations you get.0 -

Absolutely standard rejection drivel template, populated very simply with one or two bits of data pertinent to your parking event to make it look like they've read and considered your appeal carefully before rejecting it.
You'll now need to convince POPLA of your case, using the NEWBIES FAQ sticky, post #3 to develop that appeal. Let us see your draft for critique and fine tuning.
