  • I wrongly it seems allowed the landowners time to reply to my letter but as I said THEY took so long not me. Is there anything I can now do to move this on POPLA suggested asking Premier for another code, not me. Should I write to Premier again.

  • Just had a reply from PREMIER and they refuse to issue another POPLA number saying that there are 2 choices either pay the money or they will start recovery action. They also said that any further corerespondance will not be answered

    I have been advised by a solicitor friend of a friend that on no account should we pay the PCN as it is an easy one to defend as both Premier Park and The National Maritime Museum are at fault but to first write to the BPA stating that one of their members has breached their code of practice and see if it is cancelled, which they would expect.

    Yes, in terms of a breach of the BPA CoP that requires members to comply with the law and consider the additional rights and needs of disabled people. Given they have a policy of an extra hour at this site for disabled people there is no lawful excuse to deny it to this known disabled person.

    Emails to Steve Clark or Gemma Dorans at the BPA are handled quickly and this is one avenue to try first. Attach a copy of the BLue Badge for the BPA to see, and a copy of the PCN and a pic of the sign offering an extra hour.

    Another angle is to threaten to sue the Maritime Museum for disability discrimination of a visitor who they know is disabled and meets their policy.

  • As advised I complained to Gemma Dorans at BPA who in turn sent me a link to lodge a complaint, which I duly completed.    Have just received e mail from them stating that they are unable to cancel a PCN but reading the attached files it appears that the company acted within their guidelines so they cannot help any further.

    This all revolves around (a)  The company say the yellow button to claim the extra hour wasn't pushed  (b) My husband maintains it was and either it wasn't pushed sufficient to register or there was a malfunction with the equipment.      Either way the evidence produced showed that we were entitled to the extra hour with his blue badge so the company should have cancelled the ticket.     What is my next move as we have received a final reminder saying it will be passed on to debt collectors for the £115.  A previous post suggested contacting my new MP as there are numerous cases on here concerning this company Premier Park and it appears as in my case the POPLA number is issued on a given date but the letter didnt arrive for another 10 days and I suspect wasn't posted until about 7 days after the date of the number being given.     Hence out of time for POPLA to consider.

    Debt collectors have no power.  If you think you have missed the deadline for POPLA, try using the code and see if it still works, they last for 33 days.  If you have missed it, complain to BPA that the code was not sent in a timely fashion.  Failing all of that wait for a LoC/LBC/LBA and then come back here for further advice.
  • BPA said the code was issued in good time but no mention of the fact that I didnt receive it until 10 days after the date of issue.   POPLA have said they cannot help as the code is out of date and to apply to Premier Park for a new one which I did and it was just ignored.
