My iPad stolen from repairs shop..What are my rights?

Hi all. In a nutshell my iPad wouldn't charge (this was weeks ago) so I took it to a repair shop which was burgled (for the 3rd time unknown to me). My iPad had been stolen, shop assured me I'd get a new one. However I've had several emails from the owner saying their insurance company are dragging their heels and only replacing like for like. They want me to let them know if I want an iPad to be repaired and I'd gave to pay for the repair or a settlement for a broken iPad which they've said will be much lower than a working one. I'm both happy as how can they possibly get another iPad with the exact same fault as mine and charge to repair it? What would you say? Thanks for your input in this.

    Op I think they are right in offering you a repaired I pad at the same cost as it would have cost you to repair your own

    You wont be entitled to a new ipad from the shop but you may be able to get one from your house insurance. The shop is obliged to put you back in the position had the theft not taken place, ie, a repaired ipad of the the same spec for the cost of the agreed initial repair. Personally I'd try and push them to waive the repair cost due the inconvenience it's caused you and the loss of any personal data you may have had on the ipad.
  • Seems fair to me - you’ll get a repaired iPad, the same as you would have anyway.
    Anything else would be betterment.

    So after all the inconvenience of having your iPad taken (probably for a lot longer than the repair should have been) and losing all your data on it, you'd still willingly pay for the repair of an iPad that could have had an unknown amount of issues with it?

    I wouldn't be happy with that in the slightest.

    Only a fool wouldn’t back up their data before giving their device to someone for repair - that’s just common sense.

    At the end of the day the shop didn’t ask to be burgled, it’s one of those things and I’m sure the shop is worse off.

    Only a fool wouldn’t back up their data before giving their device to someone for repair - that’s just common sense.

    I understand any place can be burgled, but I'd expect adequate security like a large safe etc etc if they are repeatedly targeted and losing customer's items. I realise the OP wouldn't be entitled to a new iPad, but I definitely wouldn't be willing to take a broken one or pay for the repair, purely because of the inconvenience.

    Did they quote a price for the repair of your device?

    If so, expect to pay that amount in exchange for a working model.
  • I’d be asking for the cash value of iPad, in working order not a broken one. As that’s what you were expecting to be returned to you.

    If they give me that i’d let hem have the repair cost.
