Complain to the trade body (the BVRLA) for Europcar, hopefully they can shoot a rocket up their exhaust pipe.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You never know how far you can go until you go too far.
  • I have now sent a complaint to BVRLA as follows:

Europcar gave my (incorrect) details to Highview Parking Ltd in relation to a 'parking charge'.

    A) This parking charge is not a fine, nor a penalty. It is not from an 'Issuing Authority', it is from an unregulated private company. Europcar should not have replied to this request at all, they should certainly not have given my details to this private company.

    B) Europcar gave Highview Parking Ltd my old address. I have not lived at this address for over two years. All of my details are and were up to date on the DVLA system, on my driving licence at the time of rental. By Europcar giving out incorrect details my ability to reply within the appeal timeframe was severely reduced.

    C) Highview Parking Ltd cancelled their charge as soon as I challenged it. Europcar promised to cancel their £40 admin fine if the fine was cancelled. I provided them with proof that the charge had been cancelled on 25th September 2019 yet they have never cancelled and refunded their fee.

I have called seven times and on each occasion I have been told that this is way beyond their usual timeframes and it should have been refunded by now. On each occasion I was promised that the matter would be escalated but nothing ever happens. I have been promised a call back within two days on a couple of occasions, with no callback.

    D) On Monday 28/10/2019 at 17:00 I asked to log a formal complaint and was promised that the complaint had been raised and I would be emailed with the reference number immediately after the call. This never happened. (When I subsequently called back there was no record of it, and I logged a further Formal Complaint. This time I insisted on waiting on the phone until the number was issued.).

I can provide recordings of all of the calls mentioned above.

    I believe that is wrong.

As the Registered Keeper, Europcar did the right thing by notifying the PPC of the hirer's details. By doing this they are absolving themselves and transferring liability to the hirer, i.e. you.

    Para 13 of POFA2012 refers.
