Car People sold car with finance

Asking for help on behalf of my son.

He bought a used car outright from car people 6 months ago, just gone to trade it in and the dealer has refused as it has outstanding finance, according to HPI check, with Vauxhall original finance.

Went back to Car People to "discuss" they claim all cars are HPI'd prior to sale but as accounts are closed not much they can do tonight.

Their website claims all cars are HPI'd prior to sale

He asked them to buy the car back then at matched price of we buy any car as they advertise they will and they refused to value the car as it has outstanding finance !!

He's gutted he is supposed to be getting his new car Saturday but cannot now as no one will take the old one.

Are we right in thinking ultimately Car People are responsible here ? and although it may take time they will have to sort this out ?

    Your post is confusing.
    Are you saying Car People said the car was finance free when you bought it from them? Or you did not notice you were signing a HP agreement when you bought the car from them?
    Did you buy the car on instalments or cash outright?

    Sorry, the car was bought cash out right. Car People say all their car are HPI'd prior to sale and any outstanding finance cleared (such as stocking loans or fleet sales)

    But now he comes to sell it neither We Buy any car or the original dealer will buy it as they both agree its showing as outstanding finance ! But he bought it cash 6 months ago.

    We just did our own HPI via Total Car Check and confusingly its showing finance free...totally confused now.

    15. Have your cars been checked?

    Ok so this is a horrible situation because if you were to take any action against Car People you would have to prove they KNEW the car had outstanding finance when they sold it to you, not easy.


    So first thing to do would be to contact Vaxhall finance to clarify if there actually is still an amount to be settled. If there isn't great, get them to update their data base. If there is, well your back to arguing it out with Car People.


    Check the paperwork from Car People that it actually states it's finnace free, Car people saying it wasn't won't be good enough if you need to go to the small claims court.


    Finally, it's not unusual for a vehicle to show outstanding finance which has actually been settled.

    Been to Car People this morning they are not really being helpful, they now claim they bought the car from another dealer and it had finance outstanding when they bought it it seems but they failed to spot it.

    So they failed to HPI on 1st purchase and failed to HPI on sale to my son.

    They've basically sent him away while they investigate ! how long that will take God only knows

    Little to investigate in my opinion. Whatever the outcome internally, it is irrelevant to your son. They sold a car to him with outstanding finance on it and are, ultimately, liable. I would be pushing them hard for a resolution.

    Agreed - not the O/P's sons problem, however the issue here is that the O/P's son is time constrained.

    I would say the new car will have to be put on hold for a few days until the son has clear title, or abandon the idea of changing the car until this is ultimately sorted out.

    Lesson learned even from " a car supermarket" spend your own £20 and check that HPI !

    HPI on HPI (official) site shows finance outstanding to Vauxhall (cost £20)

    So cant even trust some HPI sites.

    As i said previously you need to get something from them in writing as they have now admitted liability.
    Also please call Vaxhall Finance and ask what the outstanding amount is. The legalities of it are your son does not own this vehicle and Vaxhall could come take it at any time.

    Not necessarily true. If the buyer can show they've purchased a vehicle in good faith then they will have good legal title.
  • Ok just to give a final wrap up, as most OP's don't !

    Based on the 2nd HPI( which had data) and Car Peoples lethargy, add on his youthful desire to get a new car tomorrow, he did call Vauxhall finance.

    They confirmed there is no fianance outstanding ! just a left marker as someone previously posted.

    Took him a whole 5 mins...where as CP were still dithering.

    Vauxhal emailed a confirmation letter to him.

    Guess what... Car People still refused to buy the car ! as despite the letter "the computer" still showed a marker.

    So in the end in frustration he went back to WBAC and they at least saw some sense and accepted the letter at value and purchased the car. Yes they low balled him (as expected) but finally its gone...and so are Car People ! never again.
