Car accident compensation

Hi i was in a car crash were someone didnt stop at a junction and i went head on to the side of there drivers door the lady who pulled out has accepted liability and her insurance company have all ready paid me for the damage coursed to my car ( write off) at the time of the crash i was 7 and half months pregnant and had 2 of my children in the car luckily my children only had bruising, i broke my sternum (breast bone) was bruised from my neck to my knees and had sever whiplash in my neck and back i also had to have steriod injections as there was a risk that my placenta would rupture also i have a rare blood group which in pregnancie i have to have antid because of the crash my babys blood mixed with mine which then i had 2 doses of anti d to stop our bloods mixing also due to the pain from the broken sternum i had to have a c section as my baby was breech it would of been way to painfull to have my baby turned due to the chest pain i already had ,,,, when i spoke to my solicitor she advised that as the lady had already addmitted vault then i could go directly to her insurance company without the need of a solicitor which i have done and had to see a doctor that her insurance arranged, i now have been told that they will be intouch with me with a settelment offer but i have no clue on what amount i should think was reasonable and what would i do if there offer wasnt reasonable how does it work if i turned it down.. thanks for any advice

    I find it hard to believe that a solicitor would have given such appallingly bad advice. You need to find another, who specialises in personal injury claims.
  • The solicitor said that i would be able to put in a claim for compensation without her help as the lady that coursed the crash had addmitted fault so i phoned up the ladys insurance company then they arranged for me to see there doctor which was today now iam at a loss because how am i meant to know if there offer is reasonable, is it to late to talk with a different solicitor or should i wait to see what there offer for settelment is ?
  • You've suffered serious injury. Personally, I wouldn't trust the other party's insurer to deal with the claim properly. You need to go to a specialist personal injury solicitor who will take on the claim on a no win no fee basis.

    When was the accident? What's the rush?
  • The accident was in may, there is no rush to settle things with the insurance company iam just worried as i have been told today that a copy of the report from the doctor i seen will be posted and i will have to sign something and then i should have a settelment offer shortly, but i dont know if they will be fair or not with the offer or if i should reject it, going of the replys i have had from other people on here iam best getting a solicitor

    A settlement offer is an offer to say "Thanks, and let's draw a line under the whole thing now for £X".

    You do not have to accept it. If you think you might have lasting after-effects - the whiplash is probably the only likely cause of that - then it's probably wise not to.

    Only you know what you'll think is a reasonable figure to settle now. If you cannot agree, then ultimately it'll go to court, and the court will decide.

    You are entitled to your quantifiable losses (eg loss of income), which should be easy enough to calculate, plus something for pain and injury, past and possibly ongoing issues. The latter calculation is where you need the advice of a professional.
    No free lunch, and no free laptop ;)
