Notice of Proposed Allocation - Small Claims

Today, I have received a “ Notice of Proposed Allocation to the small claims Track “
This has turned into a NIGHTMARE....in every sense of the word. Original date of parking said vehicle was 18/03/2018 ..!
My Husband was dealing with Parking Eye et al . Including an appeal .

The situation was/is we entered a Car Park which was not the Railway one we intended to use ,which was full. The second choice car park only took Cash which neither myself or Husband in the correct amount s.We had cards , After trying unsuccessfully to make a payment via phone on several occasions , we walked to the Railway strong some 10mins walk as our train was now due. The payment was then duly made via telephone online.
The subsequent text messages confirmed this .We had 12 hours parking paid for.
Yet, we received a Parking Eye Fine . Which as mentioned my Husband took as far as an unsuccessful appeal.
Now , I am getting County Court Paperwork in my Name as the Vehicle is registered to myself.
This latest paperwork is daunting & I am now completely peed off with the whole thing .
Has anyone else had this same issue & how did you get on ?
#Bewildered#Confused.

It is not a fine, it is an invoice for the harm they allege they suffered when you did what you did.

PE signs are unfit for purpose imo, read this

Nine times out of ten these tickets are scams so consider complaining to your MP.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
You never know how far you can go until you go too far.

At the top of this board is a thread that tells Newbies to read it first. The second post in that thread deals with the court process. It has a walk through guide for you.

The reason it's been written is because thousands of people have gone through this.

Meaning you already had a claim form in July/August and have already submitted a defence (presumably without researcing here first?).

Please show us what your defence words said exactly, as you must have a copy? We an only work with what you have already put in the defence, you can't ambush with more, so I hope you covered lots of bases and understood at least, how to distinguish your case from the Beavis precedent case that P/Eye won in the Supreme court in 2015?

You do need to read the NEWBIES thread post #2 about 'what happens when and how to do your witness statement and evidence.
