RBS PPI enquiry rejection

Hi Martin and the Forum
My wife contacted RBS via the FCA website because she had personal loans between 1988 and 1991 with NatWest and is convinced she had to take out PPI. Unfortunately she has no documentation. The reply from RBS says that they cannot access information relating to accounts closed before August 2001.
Is there anything we can do?

    Yes, if they have no records, you'll have to accept it.

    You'll never know for sure I'm afraid, but (three decades on) do you not honestly suspect your wife's conviction is more than likely wishful thinking rather than an actual memory?

    PPI did not become widespread until much later...

    if you hold no records and they hold no records then its game over. Nobody else will hold data.

    It isn't surprising there are no records as it was over 30 years ago.

    That doesn't mean it was missold. It was perfectly valid to have a condition like that. Indeed if she's confident she knew she had to take it out its only missold if it actually wasn't a condition of the banks and they lied about it when she went to the bank.

    Which would be more than tough to prove 30 years on with no records.

    Send a SAR. I got copies of bank statements back to the early 1990’s from RBS/NatWest.

    In addition to my aforementioned question, I have another question if you don’t mind helping me out. If you don’t get the required info via the SAR from the company, what’s the difference between complaining to the FOS and ICO? Do you only complain to the FOS about your PPI complaint and complain to the ICO about your SAR? (I.e lack of info/company not giving you the info you requested) Thanks

    You could probably complain to both, saying to FOS that you don’t believe RBS have investigated your complaint thoroughly, but I don’t think you’d get very far because FOS can’t force the bank to reveal hidden data, or data that may no longer exist.

    If the SAR doesn’t produce anything useful, then you could send a failed SAR letter (see ICO website), and if you get the same response refer it to the ICO on the grounds that you suspect the bank has not fully complied with your request.

    This does not guarantee the ICO will investigate, you can only try and see what happens.
