Advice on the DQ itself is to send it ONLY to the address on the form and similar advice has been found on other law sites. However, the claimants these days seem to delight in sending a copy of their DQ to defendants - maybe to frighten them into knee-jerk reactions - but I've seen nothing that states do NOT send to the claimant.
The letter accompanying the DQ says to send a copy to the Claimant, doesn't it?

Yes it does - at the bottom

"and serve copies on all other parties"

I best photocopy it tomorrow then!

    Coupon-mad - Yes it does
KeithP - Yes it does on N149A

I've never received a N180 or a N149A but OP since you have, you might have read them. Anyway I'm educated now - at least on this point!
  • Ok. So I now have the date of the court hearing. End of March 2020.

I have 3 weeks to provide my statement and any witness statements, so I will do this this coming week. Email BW Legal it, and post it to the courts.

Regarding witness statements. I could ask my colleagues who was there to provide a statement, but he wouldn't be able to be at the court hearing as he lives far away now.

Nope - unless BWL have confirmed the will accept service by email, you should post your bundle to them (with free certificate of posting from your PO counter).

In terms of the court, you should hand-deliver a neat paginated bundle in a ring binder - your WS, and supplementary WS (if you're arguing Abuse of Process) and a separate section within the binder incorporating your cross-referenced evidence). You also need to put in your costs schedule.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
