... it has just dawned on me that I may need to physically go to Northampton with a witness statement....to an actual court.
Again it has to be said... please re-read Bargepole's 'what happens when' post linked from post #2 of the NEWBIES thread.
Amongst lots of other good stuff, you will find:The case file will then be transferred to your local County Court...1 -

You really need to slow down and read the NEWBIES thread and understand what happens when, how and where. Of course the court will be your local court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks again KeithP and Couponmad for advise on local county court and thanks to Umkomaas regarding final tweak of defence statement regarding abuse of process. Defence now sent, so I will keep the thread updated with my progress.
BWLegal have now started calling me, about 3 calls in the last week. I have not engaged them in conversation as when they phone me they asking me to provide details such as address, DOB, car registration, etc. I have only just sent the defence so there is no chance they are aware of it but could they have been advised of my SAR from BPS? I assume the advise would be just to ignore these calls not engage in discussion regarding my claim?0 -

Just block them on your phone, BWLegal are simply bully boys
The incompetence that reigns in the parking scam probably means that BPS have not told them.
BWL will know soon enough and they must decide whether they discontinue or go to court.
Mind you, they will have to answer to a judge on what authority do they have to circumvent the law being POFA2012 and the courts own double recovery rules. .... THE FAKE £60
More and more judges are waking up to this scam2 -
When I sent my AOS paperwork to the CCBC I also emailed an SAR to Bristol Parking Services Ltd (6th Sep) to attempt to find out why my visible and issued parking permit was invalid. They initially responded requesting identification to verify who I was, which I happily obliged with, but today they responded with only a copy of the NTK originally sent out. They didn't send out any of the photos they originally took? I'm quite surprised as I thought they were legally required to send this information and was hoping to have it to hand (as I never took copies at the time) when or if I need to prepare a witness statement.0

The problem is that these parking companies are not blessed with any form of intelligence
They must send you everything that relates to you and that includes the photos they have on you/car
Remind them they have failed the SAR and they must correct this immediately, failing which you will report them to the ICO1 -

So that includes all photos and notes and copies of letters, internal file notes, electronic records, contact with the DVLA about your VRN, any data sharing with debt collectors over the months - i.e. all of it (but not a copy of the signage or landowner contract but you will see that later).
Email them back and point out they are in breach of the SAR regulations in the GDPR and prompt them to show you ALL data held, and give them a timeline (say 7 days) to produce it all or you will report their serious breach and wilful withholding of data, to the Information Commissioner to investigate.PRIVATE 'PCN'? BWLegal have now sent me a 'Notice of Intention to Proceed' advising me that they have received a copy of my response to the claim from the court and that their client intends to proceed with the matter notwithstanding your reason for disputing the claim. It seems to be a last ditch attempt/threat to get me to pay and gives me a deadline of 18 October 2019 to again settle the inflated balance. I'm still waiting on the BPS to respond to my complaint after they didn't fulfill the SAR but I guess the situation is still as before to just wait and see if they decide to proceed or not?0

Please re-read items 7 and 8 in the list in post #9 above.1

Just ignore bwl for now and wait for your DQ from the CCBC plus your reply to your repeat SAR , play the long game , it's a tedious process
Those are the only 2 outstanding items at this time , the rest is white noise2
