Road accident cause by tarmac not yet laid by council

The traffic management should be in place prior to the materials being deposited.
There are a couple of issues from the tarmac. If its fresh to be laid why would they have tipped it? Keep it in the nice insulated 8 legger truck it came in to feed the layer machine. If its plainings then they would be loose and not cause much damage as they are effectively gravel. Why do anything at all without all that lovely chapter 8 compliant signage and segregation in place? Sounds a bit off. How giant is a giant mound? So small you can't see it but big enough to be a problem.0 -
Hi all, sorry been busy at work, basically the ring road around my street was being resurfaced when leaving my street there was a sign stating that road works were in place but nowhere to be seen was a sign saying road closed. However at both sides of ring road there is but nothing to tell me this? I don’t know about the tarmac I was too busy traumatised about my car being stuck in the middle of it on said giant pile but It could of just been loose plainings. It has caused part of my number to come off and the reg plate. Upon first approach I thought maybe they had put in new traffic calming measures or something like that but as the sun was in my eyes I couldn’t see it properly until I was already there and realised what it was. I know I’m a giant idiot and should of drove around it but it’s a bit to late for that haha thanks everyone0

The key point is ... if you can't see (e.g. sun in your eyes), then STOP. (Or slow to a speed commensurate with the distance you can clearly see ahead).0

Although if this was a live site and the signage wasn't as per the contractors Health and Safety Plan and traffic management then they may be negligent in notifying residence or installing signage as per their plan. Worth a call to the contractor I think.0

If the OP is accurate in their description, I'm sure there are grounds for recourse.

There may be "contributory negligence" by the contractor, but the main fault lies with the driver.0
