Road accident cause by tarmac not yet laid by council

Hi all this morning as I was driving to work council had just put up signs saying road works however not blocked any roads however when leaving the street the have piled a giant mound of tarmac just into the middle of the road not blocking it off or anything, I didn’t see this till the last minute because the sun was shining in my eyes and by this time it was too late. Surely they should of closed that part of the road off is the council to blame or is this totally my own fault. Thanks in advance

    Be glad it was only a pile of Tarmac.


    I appreciate Tarmac on Tarmac could be difficult to see but should have slowed down.

    If it was night time you may have grounds for a claim, but in daytime i doubt it.

    You can always ask your insurance company to step in who will then decide if you or the council were negligent.

    I disagree.

    Surely someone, even the council, can't deposit a pile of tarmac in the middle of the road and then not take responsibility for doing so.

    If the OP is accurate in their description, I'm sure there are grounds for recourse.

    Those are different to a pre-determined and pre-meditated dumping of some tarmac. The council/workers would surely have had to do a risk assessment if they wanted to pile-up some hardcore on a public highway. I can't believe that would not have mentioned the need for signage, dangers of live traffic etc.

    We recently had to put a skip on the road outside our house - we needed a permit and it had to be lit at night. We didn't just dump it in the middle of the road and shrug our shoulders at the ensuing chaos.

    A photo would help but I inferred from their description that the roadworks are signed, perhaps the OP's own road was closed and they hit the tarmac whilst trying to leave on the closed road. Could be wrong but on the OP's description as it stands, that's what is looks like.

    The sun shining in their eyes is the concerning bit. If they couldn't see a "giant mound of tarmac" because of the low sun, they shouldn't be moving forwards at all.

    I'm sure we'll be drip-fed more information shortly.
