Hi just to let you know that I spoke to the owner above and raised my concerns -he said upstairs flat had been converted but not rented out at all so he wasn’t doing anything wrong. And also that he could have ‘permitted development’ after ten years to keep it like it is.
He said he is determined to rent out the top flat. And he will be able to do this apparently.
I told him what my solicitor had said about not having any previous planning permission or building control but he still thinks ‘permitted development’ will allow him to do this.
It’s just sad because this was my only chance to buy as my mortgage offer runs out in a few weeks and I’ve just left my job to do supply teaching instead. This means I know I won’t be able to get a mortgage again for a few years and definitely not in a flat that lets me keep my caring role.
Oh well, carrying on renting for a long time it is!😢. It just doesn’t seem fair.
As this is a flat, does he actually have any "permitted development" rights?0 -
No there are two now. He’s turned the top floor of his maisonette into a separate flat with a little kitchen and bathroom. There’s only one family inside at the moment but he said he wants to sell the maisonette as two separate properties.
I really do need this flat tbh for my caring role or I’ll be renting forever. I know it’s complicated but it might hopefully just be a case of me saying he can’t do it. End of. And he’ll sell it as one maisonette.
He can't just divide an existing property into two!
In order to create a new dwelling, which is whats happening, then they would need planning permission, works would need to meet building standards (fire, emergency escape etc), permission from freeholder, etc0
