Indeed they can.
But so long as it's been stated up front, I can't see any great issue. I presume this is tied to refusing to pay for a claim where the driver's above the limit. So you'd be free to claim the term was unenforceable in court when they pursue you for the debt...0 -

Admiral ask about speed awareness courses at renewal, but you don't need to phone them up to tell them beforehand.0

At renewal or when applying for alternative cover. It falls off the DVLA site after 4 years. Insurers ask for five years. And the guy at the bar reckons its probably 3 years.0
