Paid for 2 sessions but a gap between and Fined when the machine was broken

Hi All

I usually always pay for parking but in the two instances here ive been met with 2 fines all under unique circumstances.

1st charge was in a m&s car park. I went to pay at the machine and both machines were broken. Nothing i could do so i continued on my way.
A few days later i recieved a penalty charge notice, for parking longer than the allowed period (by 30 mins).
I will be contesting this by stating that both payment machines were broken so i assumed that parking wasnt being monitored? What are your thoughts?

2nd Charge. At a Marriott hotel in london. I parked, paid for the 2 hours. (11-1) Took my daughter to the hospital attended her appointment. Because she was having some tests done my phone had to be turned off as a result there was a period where my parking was not valid. (1-2) As soon as i could i paid for the second sesson (2-4) after which I took her for some food and went home. I am now am being sent a parking charge notice for not being parked from 11-4. The machine was broken here as well.
Im a little unsure how to contest this one?

    1) are you sure it was a penalty notice ? I doubt it if its an M & S car park, more likely a parking charge notice, or PCN


    in which case , which PPC issued it ?


    2) name the PPC
  • You are correct they are parking charge notices not penaly charge notices.

    The M&S car park was EuroCarParks
    The Marriot hotel was ParkingEye

    Appeal both as described in post #1 of the NEWBIES FAQ sticky thread.

    At the same time complain to M&S.

    The Marriott Hotel is a bit more tricky because you apparently used their car park but went somewhere else. Is that right?

    Firstly, there is nothing unique about eirther, secondly they are not fines.

    What you have received is invoices from a private company seeking damages for the harm they allege you have caused them. You owe them nothing unless a judge orders you to pay them. Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.
