Parking Eye CCJ Challenge

Parked at the Holiday Inn Cambridge funnily enough for a speed awareness course on the 23/05/19, I actually paid the ticket (approx £4) but I have a feeling that this should have been validated inside the hotel (there may be some CCTV footage of me paying?). Anyway put the ticket on the dashboard in clear view. Then I was sent letters from Parking Eye for parking on private land in breach of their t+cs. Never bothered with the follow on letters and just shredded these thinking they would eventually give up also never kept the original ticket I bought. Then I have received the CCJ from the County Court Business Centre issued 19/08/19 asking to pay £175. Can anyone help me with how to proceed next especially since time is now ticking I am keen to challenge this.

    Be careful of your terminology as well. You haven’t had a CCJ, you’ve been served a County Court claim. A CCJ is a judgment that comes at the end of the process.

  • Paid cash or card? Obviously if you can prove payment by other means that'll help.

    They almost certainly won't have routine CCTV retained after 3 months, but you can ask....

    I don't know when motorists will start taking the sorry state of affairs that parking has become in this country seriously.


    The government have passed a bill to sort this all out but are concentrating on other things at present.


    But why on earth anybody ignores these legalised scams and buries their head in the sand these days is beyond, me but you are where you are


    It took me less than a minute to find this:

    • Our car park is under the control of Parking Eye solutions. All guests, visitors, conference delegates & Health Club members will be required to enter their vehicle reg. into a monitor located at reception. Failure to do so could result in a £100 fine.

    There won't be any CCTV footage of you paying in the likely hood there ever was it is too far back now.


    You are now in the clutches of the most litigious private parking company in the UK and need to get up to speed quickly.


    Note the HI website has wrongly called this a "Fine" it's not it was an invoice for failing to observe Parking Eyes devious T&C's.


    You do not have a CCJ you are being taken to the small claims court, and need to set up your defence start by reading the newbies thread on page one of this forum.

    With a Claim Issue Date of 19th August, you have until Monday 9th September to do the Acknowledgement of Service, but there is nothing to be gained by delaying it.     5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of [URL="https://forums.moneysavingexpert.com/discussion/4816822NEWBIES FAQ sticky thread[/URL] to find out exactly what to do with it.

    Many thanks for all your responses, very grateful - I have a lot of reading to do and it sounds very complicated! I had done the acknowledgement of service but stupidly at the time I ticked the box marked counterclaim as I wrongly thought this was all part of the defense. What should I do next : 1. Can I get in touch and ask to remove this (I noticed that I have to pay for this) and if so who do I need to contact? 2. Will this affect the additional 28 days period I was hoping to gain and is there anyway I can check when the exact deadline is? 3. Once I put my defence together is there somebody that could check it for me and if so how do I go about sending this?

    What do the stickies/FAQs say? All your questions are answered there, have you read them? You really need to put in the hours here, (or pay what they are asking).

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    You might have to complete this form. Counterclaims cost a fee, so when they don't receive the fee, it will fail. However, you could try an e-mail to CCBCAQ@Justice.gov.uk, explain what you have done and ask for it to be removed.
