@redx thanks, Im hoping that HR can sort me out, I realise that appeal grounds are weak on this site given what I've read.
@thedeep yes I've quoted part of that document in my email to the hospital. I will complain to my MP.0

I'm not sure that I've seen any PE cases go to court for this hospital site, it may be that they have not been given authority to pursue staff and patients through litigation.
Possibly the Trust were shocked by the Indigo court debacle that cost their staff very dearly and are reluctant to see a repeat? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

It might be worth submitting an FOI to the hospital asking to see the contract they've signed.0

And to ask, even if they refuse to divulge the contract, then can they answer:
 (a) how many cases regarding this parking regime have gone to court, and
 (b) whether the parking firm has that right or not, or would any court cases be from the NHS Trust as creditor and Claimant? and
 (c) any correspondence or minutes of meetings where the NHS Car Parking Principles were discussed and how the enforcement was reconciled against that Government policy, given that allowing a private firm to retain revenue as penalties only, actually breaches those official rules?

This needs cancelling by HR , as I stated earlier

I disagree, I was in a PE car pay yesterday. The small proint on their signs was at least seven frrt off the ground, over 400 words long, and some in minute print. All you need is a judge to agree with you and they are toast. You never know how far you can go until you go too far.0

In addition to above advice, make sure you complain to your MP and Assembly Member - they usually have contacts in the Cardiff and Vale Trust and may help you get the ticket cancelled.
Cardiff MP's Kevin Brennan and Stephen Doughty spoke in favour of the Parking Bill when it was debated in Parliament.0

Thanks Red, you've got a better memory than I have about that PE site. I'm surprised I forgot about it given the 'rawness' of the Indigo trampling of the hospital staff.
I don't think we've seen any other PE court cases there? It's such a large hospital, I would have thought we'd have seen many more cases coming for help if PE have unbridled authority to issue proceedings. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Agreed , this seems to have been the first we know about, so if you check the posts I was trying to get the point across but the OP indignation on behalf of his wife clouded better judgment , leading to playing catch up and losing in court , possibly to the same judge as in the Indigo debacle, probably the same Cardiff court too ?
Cardiff has a bad record where defendants are concerned , whereas Manchester and some south coast ones fare better due to more clued up judges, when we talk about Judge Bingo , we mean it
The fact that the PE contract and signs are recent also means less to argue about for that site , compared to older sites
This one stuck in my mind due to the saga plus I contributed to the indigo case prior to Parking Eye taking over0

An update for you all. Not really sure how it all has gone down tbh.
Sent multiple emails to the parking department with polite but firm rebuttals that they could not help as the permit was not issued before the parking event.
Anyway I submitted the standard appeal but attached a permit confirmation letter to PE.
Just received an email with an attached letter saying they've cancelled the charge as a gesture of goodwill.
As I said not sure how it was all so straight forward.
Will still send my drafted emails to MPs as it was still not a pleasant experience.
A big thank you to everyone who helped out on here. A great source of support.0
