County Court Claim form - Horizon Parking - Urgent help needed!

  • Hello @Coupon-mad, Reddragon123 here, the reset password function wasn't working.
    Referring to my old post,
Going through  @chefdave's witness statement and exhibits, how can i alter mine to match? As they are stating I breached the agreement 4. Also, there is a camera on entry of the car park which detects the number plate automatically. I did ask for a SAR previously but none was provided. I have now got the defendants witness statement with the images, letters and their car park management agreement with the landowner.
They have also mentioned how the signage has been audited by the BPA within their witness statement. Shall I be worried? Also, there was no date given as to when the evidence had to be filed by, even checking my small claims hearing letter.
Thank you so much for all your help and I'm sorry for not taking this more seriously earlier.
I've also gone to take pictures of the signage at the carpark and the signage upon entry has been destroyed?
I've attached that here, and then the signage upon parking is not fully visible due to the bush next to it, also attached.
Shall I mention in my witness statement how they did not provide PDT machine records from the days they're accusing me of breaching for?

A whole week has now passed since Bargepole wrote:
You will have received a Notice of Allocation from the Court, requiring you to file and serve your Witness Statement, and any evidence relied upon, not later than 14 days before the date of the hearing. It looks like you didn't bother to read or understand that, nor did you read the info in the NEWBIES thread which explains this process - if you had done so, you could have prepared your statement in good time.
As it stands, you now have roughly 30 seconds in which to get that done. Lack of preparation and planning on your part does not create any urgency or emergency on our part.

Note the sentence: "As it stands, you now have roughly 30 seconds in which to get that done."

What has happened in the last week?

As we don't yet know when your hearing is, nor the deadline for the filing of your Witness Statement, evidence and Summary Costs Assessment, it is difficult to understand your plea for urgency.

Hearing is on the 4th of august but the letter doesn't state as to when the WSA needs to be filed.

I will have this prepared by the end of the night and send it off to both the Claimant's solicitors as well as the court tomorrow first thing. Via email is okay right?

Look again at your Notice of Allocation. The Notice that gives the hearing date.

Is there not a paragraph something like:
Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
    Might be on the back.

Those documents you intend to rely on are your Witness Statement and evidence.
  • I have finished both my witness statement and exhibits, just need to finish off my Supplementary WS
  • Should I be editing the [...] in paragraph 3.1 of the sup WS?
Apologies for the lateness in my urgency to follow through with all of your advice, due to the letter not stating any specific date for me to provide my WS or backing evidence I left this to the side.
I also didn't receive any notifications regarding your feedback, I thank you all so much for helping me so far.
I have attached the 3 documents, WS, exhibits and supporting WS.
I look forward to your feedback. I have highlighted my changes in the supporting WS.
    Kind Regards,
    Reddragon/Dfightingfit

There was no section stating this. It was however stating how this hearing is a provisional listing. I have sent over all my supporting documents to both the claimant's solicitors and the county court of milton keynes.
I will continue to read the thread and stay on top of this.
Apologies for not taking all of your advice more seriously and thank you for continuing to support me with this although I've been taking your help for granted.
