Lease car - transfer of liability communication

  • Yes, this was at Newcastle Airport.

    I have spoke on the phone and sent an email to the lease company requesting a copy of all correspondence between them and UKPPO.

    I have also asked them not to pay (as they have in the past without giving me the chance to appeal!!!) and stated that if they do pay I will not be reimbursing as it is unnecessary and they are not required to do so.

    I have no idea where this is going to go now.

    Edna - what was the outcome in your friends case when UKPPO did not accept transfer to hirer?

    Not good I'm afraid. My friend's car was a company vehicle, the hirer of which was his employer. This meant that he was having to deal with UKPPO through both his employer and the lease company.

    He did eventually get a letter from the lease company giving him authority to act on their behalf. However after a couple of letters back and forth between him and UKPPO, they simply cut him out of the loop and reverted to pursuing the lease company directly.

    As long as a potentially gullible lease company is on the hook, there is no chance that UKPPO with reissue the PCN to you as a notice to hirer. All you can do is to try to take control from the lease company by requesting that they give you written authority to manage the dispute against PCN on their behalf. You really need to make them aware of the increasing number of Court cases which have exposed UKPPO's antics at NCL to be nothing more than a scam.

    Unfortunately C-M, I don't think the OP will get the chance to defend this in Court. NCL byelaws cases are a rare example of where hirers are in a worse position than registered keepers.

  • OP here again. As advised in this thread, over a week ago I both called and emailed the lease company requesting a copy of all correspondence between them an UKPPO. I received nothing.

    I called them again today and was told that despite trying to transfer liability after both the original PCN and the uplifted charge they received no answer from UKPPO.

    After explaining my case I was told that I should call UKPPO to ask why they have not contacted me. I said I am not sure they will speak to me as as far as UKPPO are concerned at the moment, the lease company is the registered keeper and I am not involved. I was then told that 'if the issuing body do not accept to speak to you then please contact us and we can look into paying the fine at the lower charge on your behalf of £60 as a gesture of goodwill.' I have this in writing in an email.

    Another point possibly worth noting: in a previous parking charge involving this lease company the PPC would not accept transfer of liability as the signed contract they have between myself and them does not have the car registration on it. I believe this could be because I signed the contract before the exact car was available!!??

    Any ideas on the best way forward? Bearing in mind the deadline for the charge to increase to £150 is now only 2 days away.

    That is daft & cannot happen. PPC scammers do not know of the meaning of that phrase.

    UKPPO will not agree and why would anyone want to pay them a penny. This will not resolve it and the lease firm are giving them too much respect - they need to transfer liability to you, end of story.
    Any ideas on the best way forward? Bearing in mind the deadline for the charge to increase to £150 is now only 2 days away.
    Who cares, as long as liability is properly transferred to you, then you won't be paying.

  • Coupon-mad: Thanks for your comments, the gesture of good will is from the lease company. They seemed to suggest they will pay the full charge without charging me for it then attempt to appeal to get it reduced which seems impossinle at this stage.

    I will call UKPPO this afternoon to as why they failed to recognise the transfer of liability.

    Does this sound like a good idea?
